Book Synopsis Law and Society in the South by : John W. Wertheimer
Download or read book Law and Society in the South written by John W. Wertheimer and published by University Press of Kentucky. This book was released on 2021-12-14 with total page 336 pages. Available in PDF, EPUB and Kindle. Book excerpt: Law and Society in the South reconstructs eight pivotal legal disputes heard in North Carolina courts between the 1830s and the 1970s and examines some of the most controversial issues of southern history, including white supremacy and race relations, the teaching of evolution in public schools, and Prohibition. Finally, the book explores the various ways in which law and society interacted in the South during the civil rights era. The voices of racial minorities-some urging integration, others opposing it-grew more audible within the legal system during this time. Law and Society in the South divulges the true nature of the courts: as the unpredictable venues of intense battles between southerners as they endured dramatic changes in their governing values.

Book Synopsis Law, Technology and Society by : Roger Brownsword
Download or read book Law, Technology and Society written by Roger Brownsword and published by Routledge. This book was released on 2019-02-18 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book considers the implications of the regulatory burden being borne increasingly by technological management rather than by rules of law. If crime is controlled, if human health and safety are secured, if the environment is protected, not by rules but by measures of technological management—designed into products, processes, places and so on—what should we make of this transformation? In an era of smart regulatory technologies, how should we understand the ‘regulatory environment’, and the ‘complexion’ of its regulatory signals? How does technological management sit with the Rule of Law and with the traditional ideals of legality, legal coherence, and respect for liberty, human rights and human dignity? What is the future for the rules of criminal law, torts and contract law—are they likely to be rendered redundant? How are human informational interests to be specified and protected? Can traditional rules of law survive not only the emergent use of technological management but also a risk management mentality that pervades the collective engagement with new technologies? Even if technological management is effective, is it acceptable? Are we ready for rule by technology? Undertaking a radical examination of the disruptive effects of technology on the law and the legal mind-set, Roger Brownsword calls for a triple act of re-imagination: first, re-imagining legal rules as one element of a larger regulatory environment of which technological management is also a part; secondly, re-imagining the Rule of Law as a constraint on the arbitrary exercise of power (whether exercised through rules or through technological measures); and, thirdly, re-imagining the future of traditional rules of criminal law, tort law, and contract law.
Book Synopsis Domesday Book and the Law by : Robin Fleming
Download or read book Domesday Book and the Law written by Robin Fleming and published by Cambridge University Press. This book was released on 2003-12-18 with total page 574 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Domesday Book contains a great many things, including the most comprehensive, varied, and monumental legal material to survive from England before the rise of the common law. This book argues that it can - and should - be read as a legal text. When the statistical information present in the great survey is stripped away, there is much material still left, almost all of which stems directly from inquest, testimony given by jurors impanelled in 1086, or from the sworn statements of lords and their men. This information, read in context, can provide a picture of what the law looked like, the ways in which it was changing, and the means whereby the inquest was a central event in the formation of English law. The volume provides translations (with Latin legal terminology included parenthetically) for all of Domesday Book's legal references, each numbered and organised by county, fee, and folio.
