Book excerpt: Vietnam's laws on advertising represent a series of dynamic compromises between market liberalization and communist rule, between an authoritarian government's determination to attract international businesses and its reluctance to share the airwaves in public speech, and between traditional, conservative, communitarian values and the explosion of Vietnamese consumerism. These compromises are expressed in laws forbidding advertisers from using content harmful to the sound ideals and morals of the Vietnamese people, prohibiting them from making references to symbols of the State, and restricting the frequency with which advertisements can run on television, among others. Businesses keen to take advantage of the burgeoning consumer market face a host of challenges in marketing their goods. Enforcement often seems capricious and unpredictable. The regulatory system is remarkably opaque, as Laws, Decrees, Circulars, and Decisions applicable to advertising evolve simultaneously through several different levels of government. Advertisers and advertising agencies adapt through self-censorship and a reliance on long-standing relationships with the censors who act as gatekeepers at government-owned media. This Article examines the laws and their impact on businesses. It draws on a series of interviews with participants in the Vietnamese advertising industry and with other interested parties, with the goal of understanding how the laws affect business practices, the government's objectives in applying them, and what changes are likely to come in the future. It finds that while economic factors provide a strong force for liberalization of the laws, persistent cultural and political factors could exert a considerable countervailing force. In short, the competing factors that shape the current laws seem poised to drive further compromise in the future.

Shankar argues that as a form of racialized communication, advertising shapes the political and social status of Asian Americans, transforming them from "model minorities" to "model consumers." Asian Americans became visible in the twenty-first century United States through a process Shankar calls "racial naturalization." Once seen as foreign, their framing as model consumers has legitimized their presence in the American popular culture landscape. By making the category of Asian American suitable for consumption, ad agencies shape and refine the population they aim to represent.
