This book was released on 2009-12-16 with total page 408 pages. Available in PDF, EPUB and Kindle. Book excerpt: International maritime law is far from inert, everyday international affairs constantly test existing law and, in many occasions, require its development. Serving the Rule of International Maritime Law is thus not limited to a description of the current state of the law, but contains innovative studies on current issues and events that are testing the present state of international maritime law. The book is intended as a Liber Amicorum to Professor David Joseph Attard. It celebrates his career in international law; he played a crucial role in establishing the IMO International Maritime Law Institute in 1988, the main purpose of which is to train lawyers in private and public international maritime law. Over the last twenty years he has continued to teach at the Institute and has played an important role in contributing to the work of international fora concerned with the development of international law. This work represents a close collaboration amongst practitioners and academics involved in the field of international maritime law including IMO Secretary-General Efthimios E. Mitropoulos, Judge Helmut Tuerk, Professor Francis Reynolds Q.C. and Patrick J.S. Griggs CBE. Part I contains general articles in international maritime law, Part II is dedicated to the law of the sea, and Part III is devoted to issues on shipping law. Serving the Rule of International Maritime Law is of great interest to professionals in the shipping industry as well as practitioners, academics and students.

Available in PDF, EPUB and Kindle. Book excerpt: The need for freedoms of navigation in regional waters is frequently mentioned in statements from regional forums, but a common understanding of what constitutes a particular freedom of navigation or the relevant law is lacking. This book discusses how law, politics and strategy intersect to provide different perspectives of freedoms on navigation in the Asia-Pacific region. These freedoms are very important in this distinctively maritime region, but problems arise over interpreting the navigational regimes under the law of the sea, especially with regard to the rights of foreign warships to transit another country’s territorial sea without prior notification or authorisation of the coastal state, and with determining the availability of high seas freedoms of navigation and overflight in an exclusive economic zone. The book explores these issues, referring in particular to the position of the main protagonists on these issues in Asian waters – the United States and China – with their strongly opposing views. The book concludes with a discussion of the prospects for either resolving these different perspectives or for developing confidence-building measures that would reduce the risks of maritime incidents. Providing a comprehensive yet concise overview of the various different factors affecting freedom of navigation, this book will be a valuable resource for those working or studying in the fields of international relations, maritime security and the law of the sea.

Book excerpt: This book covers various strategic issues around maritime security in terms of how Indonesia has sought to implement its Global Maritime Fulcrum (GMF) vision, evaluating its regional impact within ASEAN. The Global Maritime Fulcrum’ vision was declared by President Joko Widodo to refocus Indonesia’s development paradigm to prioritize its maritime aspect in the Indo-Pacific. Divided across five pillars, namely: maritime culture, maritime resource management, maritime infrastructure and connectivity development, maritime diplomacy and maritime defense, the book presents that the implementation of this vision will doubtless have a significant regional impact, particularly in setting regional maritime agendas. In promoting an understanding of the challenges presented in implementing the Global Maritime Fulcrum and unpacking its multifaceted impact in the region, this book delves into Indonesia’s maritime vision, the existing maritime arrangements within ASEAN, and Indonesia’s interests in terms of its political economy relating to the maritime sector, strategic security issues, maritime diplomacy, and related regional power dynamics. Translated from Bahasa Indonesia into English, the book is relevant to scholars and policymakers in maritime studies, international relations, and regional studies relating to politics and power dynamics in Indonesia, specifically, and ASEAN more broadly.

Book excerpt: This book conducts an examination of the international legal regime of the continental shelf through the lens of international relations (IR), with a primary focus on global governance theory. Presenting a new perspective within the field of IR and international law, the book offers new insights into the rules, principles, practices, and actors that establish and govern social interactions and the management of common affairs at the transnational level. The governance framework within the continental shelf can encompass a wider scope than legal laws alone, incorporating informal rules or potentially disregarding formal “black letter” rules that may not be effectively applied in practice. To exemplify how governance theory and other IR theories contribute to the analysis of the legal regime concerning the continental shelf, the book conducts an in-depth examination of three significant issues: (i) the demarcation and delimitation of the continental shelf, (ii) the rights and obligations of coastal States in the continental shelf, and (iii) procedural matters related to the continental shelf and international maritime adjudication. This book will be of interest to students and scholars in the field of the law of the sea, international law, global governance, and international relations.

Available in PDF, EPUB and Kindle. Book excerpt: The four 1958 Geneva Conventions on the Law of the Sea, which codi?ed and progressively developed this sector of our legislation, were rather ephemeral despite the fact that they were constituent Conventions. In fact, the 1982 United Nations Convention on the Law of the Sea (UNCLOS) again undertook the same task with the same spirit 20 years later after a long drawn out global negotiation process in which all the marine areas and problems pending were analysed and discussed by the countries attending, and an apparently strengthened majority was attained, including the essential agreement between the principal naval powers and the third world countries, symbolised most grossly in the recognition of exclusive economic areas which were 200 miles wide in exchange for a signi?cant alteration to the legal rules applicable to the international straits. From 1973 to 1982, the negotiations showed that there were a number of particular factors affecting the seas: “strait” countries, user countries, long range ?shing countries, embedded countries, archipelagic countries, broad platform countries, etc. In 1982 when the UNCLOS was adopted, it seemed to be a text with justi?ed pretensions to be in force for a long period of time as the nine years of negotiations required for its adoption had taken into account the main problems pending agreement although not absolutely all.
