Available in PDF, EPUB and Kindle. Book excerpt: This incisive volume of the Elgar Encyclopedia of Environmental Law offers a broad analysis of the foundations, main concepts, and substantive and procedural requirements of selected chemical law regimes as they pertain to the environment. Featuring contributions from more than 40 expert scholars and practitioners in the field, the volume focuses on chemical regulatory systems from representative jurisdictions, including the EU and the US, to provide a coherent overview of this expansive and often fragmented area of law. Divided into five thematic parts, the volume first examines the fundamental concepts of chemical law, addressing topics including risk assessment, nomenclature, environmental justice and animal testing. Entries then discuss types of chemicals and exposures, regulation of chemicals in products and manufacturing, and waste and contamination, as well as covering liability rules as they apply to chemicals. This volume will be an essential resource for scholars and students looking for a clear understanding of chemicals regulation and governance from environmental and public health perspectives at both national and international levels. Its insights into policy developments and liability issues will also be of interest to policymakers and practitioners.

Download or read book War Torn Environment: Interpreting the Legal Threshold written by Karen Hulme and published by BRILL. This book was released on 2004-08-01 with total page 374 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the recent past the horrors of war have been demonstrated all too vividly. Who would have believed that after Nuremberg there would be any further need for war crimes tribunals, or for the creation of an international criminal court? But, whilst people in conflict countries suffer the mental and physical scars from military bombardment, they also suffer the silent legacy of environmental pollution. The world functions as one large ecosystem: the contamination of one element inevitably feeding into another. Pollution in peacetime has been greatly reduced, but what is the wartime cost to the environment? Wartime weaponry and tactics are strictly controlled by the principles of humanitarian law, but international law can be a slow creature. Are our militaries using weapons today that violate the current laws of armed conflict? Or need new controls be drafted to deal with the environmental, and inevitably human, consequences of modern warfare? The book seeks to analyse the issues surrounding the protection of the environment in times of armed conflict, and to pose questions as to its adequacy and efficacy. But the focus is not simply upon the interpretation of the legal provisions in isolation; instead, the analysis establishes a benchmark standard of environmental harm against which the adequacy and efficacy of the legal provisions can be measured. At the centre of the analysis are a number of case studies tackling the most modern weapons and tactics, including the legality of depleted uranium weapons and cluster bombs, the validity of striking chemical weapons facilities and oil installations, and the responsibility for explosive and non-explosive war debris.

Download or read book Hazardous Decisions written by D. Huitema and published by Springer Science & Business Media. This book was released on 2005-12-15 with total page 515 pages. Available in PDF, EPUB and Kindle. Book excerpt: where Jeremy Richardson, Albert Weale and Hugh Ward were excellent hosts at the Department of Government and Thomas Christiansen a very good roommate. Having included the UK as a country where decision processes were far less participatory (and thus ‘worse’ in my own view) than those in the Netherlands, I started doing my first interviews there, which were mainly intended to identify suitable case studies for research. But then I read a highly critical review of a book that had a similar topic as my study. The critique was that cases of hazardous waste siting cannot adequately be studied without understanding their national context. This made me decide to devote some attention to the legal context of hazardous waste siting in the three countries of interest (which is of course only a part of the national context) and its development through the years. The study of the UK system of environmental regulation and land use planning was not a simple issue, and I was warned various times (for instance by Andrew Blowers at the Open University) that the legislation was highly complex and easily misinterpreted. I felt personally touched by such warnings and decided that I should perhaps approach the UK system a bit less as an evil empire and maybe be a bit more ‘objective’ in my appraisals.
