It also investigates the extent to which customary principles and values are accommodated in legislation. Focusing on Samoa, the author argues that South Pacific countries continue to adopt a Western approach to law reform without considering legal pluralism, which often results in laws which are unsuitable and irrelevant to Samoa. In the context of this system of law making, effective law reform in Samoa can only be achieved where the law reform process recognises the legitimacy of the two primary legal systems. More recently, however, the decline of opposing global power blocs has elevated ethnicity to a prime cause of conflict over land. This book considers the multiple roles ethnicity plays in fostering territorial conflicts, both violent and non-violent, across the globe. While land disputes relating to nationalism have resulted in the loss of human life in some regions, in others ties between ethnicity and land are asserted more peacefully. Nationalism and challenges to the validity of the links between people and places have caused widespread bloodshed in the disputed territory of Palestine, involving competing claims of Arabs and Jews, have led to war. In North America, however, indigenous Indians' claims to land are settled in the courts, rather than through violence. This book shows how human behaviour is affected by the multiple ways in which people identify with land, topography and natural resources. In doing so, it highlights the growing trend towards defining physical space in specific ethnic contexts, associated with a contemporary world that facilitates global movement.

Ethnic grievances derive from lack of access to valued resources, and elites play a crucial role in allocating those resources. This book examines the experiences of five countries with a history of ethnic conflict: former Yugoslavia/Bosnia-Herzegovina, Guyana, Trinidad and Tobago, and the United States. It finds that in many cases, solutions adopted to mitigate ethnic conflict have unintended consequences. Often, supposed solutions confuse cause and effect and in fact worsen ethnic conflict. Attempts to address identity issues by pandering to them often led to further ethnic demands. This book argues that, based on the experiences of the countries under examination, the best course is to adopt policies that encourage alliances between and among ethnic groups.
