Available in PDF, EPUB and Kindle. Book excerpt: In a stunning work combining historical memory, legal ambiguity, and profound issues of justice, J. Kenneth Brody provides a picture of France in World War II that continues to haunt the present. Architect in 1940 of Marshal Petain's Vichy French regime and its prime minister from April 1942 to August 1944, at war's end Pierre Laval was promptly arrested on charges of treason. This book tells the story of his trial. Did he betray France, or did he serve France under terrible circumstances? What was the truth of "collaboration"? This book considers the pretrial proceedings, or lack thereof, the evidence, and the arguments of the prosecution, as well as Laval's vigorous defense in the early days of the trial. Because of irregularities in the preliminary proceedings, Laval's defense counsel declined from the outset to participate in the trial. For those reasons and because of the prejudicial conduct of the prosecution, on the third day of the trial, Pierre Laval also declined to participate further. What his defense might have been in a normal pre-trial proceeding and in a fair trial are matters of conjecture. What remains clear is that political trials are a unique form of law and moral judgment. Trials and history share a common goal-the truth. Trial, judgment, and appeal are intended to produce finality. History, on the other hand, is never final. After its performance in the trial of Pierre Laval, the government of France continued its policy of concealment, even though the truth could no longer determine the outcome of the trial. Slowly, by persistence, courage, and loyalty, history's claims to truth were established. This book presents the defense that might have been presented and then relates the final judgment, its grisly execution only eleven days after the trial opened, and its aftermath.

Book excerpt: The Lavals were one of the most important families in late medieval France, rising to a position of unsurpassed eminence by the mid sixteenth century. Yet, at the very point where they reached this position of unrivalled importance, all was put at risk by the dual challenges of dynastic failure and the Reformation. The vagaries of dynastic failure threatened their hard won success and these problems were compounded by the decision of crucial members of the family to support Protestantism in the middle of the century. By the end of the sixteenth century the fortunes of the family were in ruins and the brief eminence of Lavals in western France was over. This monograph offers a fresh look at several of the critical questions facing historians of late medieval and early modern France. It re-examines the clientage of a rising and enterprising family and explores the cultural patronage of a noble court. The book also provides a new insight into the nature of noble Protestantism, notably analysing the connections between nobles, patterns of family loyalty and religious conviction. Finally, it considers the events of wars of religion in western France from the perspective of a noble leadership that simultaneously played a vital role in sustaining the cause and did much to undermine it. This latter issue is examined in particular through the analysis of the relationship between the houses of Laval and Rohan, two Protestant families with shared loyalties but with rival dynastic ambitions. This study is based on a complete re-examination of the archive base in both Paris and the west of France and in English archives. For many centuries the destruction of the archives of the family of Laval during the French Revolution has prevented historians from undertaking a serious study of the family. Indeed, this book is the first monograph to be published on the Comtes de Laval since the manuscript volume written by Le Blanc de La Vignole in the seventeenth century. At the same time it engages with the historiography of both French and Anglo-Saxon historiographical traditions.

Book excerpt: EU Law in the Member States is a new series dedicated to exploring the impact of landmark CJEU judgments and secondary legislation in legal systems across the European Union. Each book will be written by a team of generalist EU lawyers and experts in the relevant field, bringing together perspectives from a wide range of different Member States in order to compare and analyse the effect of EU law on domestic legal systems and practice. The first volume focuses on the uneasy relationship between the economic freedoms enshrined in Articles 49 and 56 TFEU and the right of workers to take collective action. This conflict has been at the forefront of EU labour law since the CJEU's much-discussed decisions in C-438/05 Viking and C-341/05 Laval, as well as the Commission's more recent attempts at legislative reforms in the failed Monti II Regulation. Viking, Laval and Beyond explores judicial and legislative responses to these measures in 10 Member States, and finds that the impact on domestic legal systems has been much more varied than traditional accounts of EU law would suggest.

Book excerpt: Neoliberalism's war against democracy and how to resist it How do we explain the strange survival of the forces responsible for the 2008 economic crisis, one of the worst since 1929? How do we explain the fact that neoliberalism has emerged from the crisis strengthened? When it broke, a number of the most prominent economists hastened to announce the 'death' of neoliberalism. They regarded the pursuit of neoliberal policy as the fruit of dogmatism. For Pierre Dardot and Christian Laval, neoliberalism is no mere dogma. Supported by powerful oligarchies, it is a veritable politico-institutional system that obeys a logic of self-reinforcement. Far from representing a break, crisis has become a formidably effective mode of government. In showing how this system crystallized and solidified, the book explains that the neoliberal straitjacket has succeeded in preventing any course correction by progressively deactivating democracy. Increasing the disarray and demobilization, the so-called 'governmental' Left has actively helped strengthen this oligarchical logic. The latter could lead to a definitive exit from democracy in favour of expertocratic governance, free of any control. However, nothing has been decided yet. The revival of democratic activity, which we see emerging in the political movements and experiments of recent years, is a sign that the political confrontation with the neoliberal system and the oligarchical bloc has already begun.
