Book excerpt: En el proceso característico de las etapas postclásica y justinianea, las interrogationes pueden ser planteadas en cualquier momento de la tramitación del procedimiento, para configurarse, en líneas esenciales, como un interrogatorio llevado a cabo por el Magistrado- Juez, al propio tiempo que pasan a ser asimismo consideradas, en sentido estricto, como uno de los medios de prueba propuestos por las partes o utilizados de oficio por el propio Juez. A partir del origen de las interrogationes en el procedimiento de las acciones de la ley, su utilización se hace más frecuente en la etapa del procedimiento formulario, y si bien a partir de entonces se produce una evolución en algunos aspectos de su régimen jurídico, la idea y el contenido básico de las preguntas propio de la época clásica y del proceso formulario, se mantiene, en lo esencial, en el procedimiento extraordinario, al propio tiempo que se configuran como el fundamento y antecedente de las actuales diligencias preliminares, asimismo consideradas, como ocurría en el proceso romano, como herramientas procesales de especial relevancia para precisar o puntualizar aspectos esenciales para la tramitación del posterior litigio. Cabría afirmar, en definitiva, que la presente obra, escrita, desde la honradez científica, de forma clara, sistemática y rigurosa, constituye, a mi juicio, una notable aportación al estudio del Derecho Procesal Romano y resultará de interés para la moderna procesalística, en la medida en que contribuye a la ansiada conexión entre la investigación histórica y la dogmática moderna, tan necesaria para la evolución de la ciencia del derecho.

This volume is an investigation of how Augustine was received in the Carolingian period, and the elements of his thought which had an impact on Carolingian ideas of ‘state’, rulership and ethics. It focuses on Alcuin of York and Hincmar of Rheims, authors and political advisers to Charlemagne and to Charles the Bald, respectively. It examines how they used Augustinian political thought and ethics, as manifested in the De civitate Dei, to give more weight to their advice. A comparative approach sheds light on the differences between Charlemagne’s reign and that of his grandson. It scrutinizes Alcuin’s and Hincmar’s discussions of empire, rulership and the moral conduct of political agents during which both drew on the De civitate Dei, although each came away with a different understanding. By means of a philological–historical approach, the book offers a deeper reading and treats the Latin texts as political discourses defined by content and language.

This book presents the first comprehensive examination of the incorporation of the Flood myth into the Anglo-Saxon imagination. Focusing on literary representations, it contributes to our understanding of how Christian Anglo-Saxons perceived their place in the cosmos. For them, history unfolded between the primeval Deluge and a future – perhaps imminent – flood of fire, which would destroy the world. This study reveals both an imaginative diversity and shared interpretations of the Flood myth. Anglo-Saxons saw the Flood as a climactic event in God’s ongoing war with his more rebellious creatures, but they also perceived the mystery of redemption through baptism. Anlezark studies a range of texts against their historical background, and discusses shifting emphases in the way the Flood was interpreted for diverse audiences. The book concludes with a discussion of Beowulf, relating the epic poem’s presentation of the Flood myth to that of other Anglo-Saxon texts.

These men mapped out general principles to counter commercial fraud and dictated norms to regulate standard economic transactions. The most learned jurists, such as Matthias Coler, Peter Heige, Benedict Carpzov, and Samuel Stryk, among others, studied these theological teachings and implemented them in legal tenets. Theologians and jurists thus cooperated in resolving contract law problems, especially those concerning interest and usury.
