Available in PDF, EPUB and Kindle. Book excerpt: This workbook provides a basic, systematized account of the rules and classifications of estate law. Problem sets in each chapter let students practice applying the rules and assigning the classifications of this intricate area of law in hypothetical situations. Features: Comprehensive problem sets for each chapter (550 problems total) with fully explained and analyzed answers in every chapter help to simplify this complex area of property law, and build student confidence more than a simple hornbook or other commercial study guide Coverage of major statutory and judicial reform of the RAP (Rule Against Perpetuities) will insure that this book will not be out of date by the time students prepare for the bar exam Dynamic learning philosophy which espouses that students should focus first on the classifications of estates and future interests, then the rules governing these classifications, and only then the RAP, since the RAP builds upon the classifications and rules. The book explains these rules and provides problems and answers that carefully lead students from one difficult plateau to the next Ideal for students in both first-year Property as well as Wills and Trusts--the chapter on powers of appointment is useful to the latter Coverage of all the rules as they are applied today, with historical background of the law Systematic organization of the common law Concise and clear explanations of classifications of interests and estates Can be used in conjunction with any property casebook or Wills, Trusts, and Estates casebook Correlation chart matches the material with its coverage in several popular first-year property casebooks: Casner, Dukeminier, Singer, Kurtz, Cribbet, Makdisi, Freyermuth, and Smith New to the Sixth Edition: Removal of discussion of Fee Tails to appendix (including problems and answers), in light of the rarity of fee tail problems today, and of the fact that they do occur, they are transformed in nearly every jurisdiction into some form of life estate and/or fee simple Separation of Ch. 1 into two chapters for an easier introduction to the concepts: Classification of Estates (Ch. 1), and Classification of Future Interests (Ch. 2) More than 50 new problems and answers, with refined answers to existing problems Explanation of how several rules are used in different states (including whether a majority or minority of states use a particular rule) Updated and expanded Correlation chart including new casebooks (Makdisi, Freyermuth, and Smith)

Book excerpt: Much of the preparation of this book has been generously supported by the Lincoln Institute of Land Policy, Cambridge, Massachusetts. It evolved from a colloquium held in October 1977, under the sponsorship of the Lincoln Institute. The three-day symposium entitled "Land Policy: Making the Value Choices" involved the preparation of major papers and formal discussions, most of which appear here in considerably revised form, along with additional pieces commis sioned later. The colloquium was an idea jointly conceived by myself and Edward Wood, a colleague at the time in the Tufts University Program in Urban Social and Environmental Policy. We were concerned about two major limitations in the literature and debates over land use. On the one hand, there was little explicit recognition of the latent values that motivated land use policy. On the other, there was no common forum where people from the different land use fields could discuss the issues and learn from one another. A small group of about two dozen people was invited to the colloquium. Each member was a leading spokesman for a different perspective and area of expertise. All participated formally in some fashion. All the papers were written expressly for the col loquium, with the exception of Ann Strong's, which was a keynote address to the American Society of Planning Officials earlier in the year. None of the papers has been published elsewhere.

Available in PDF, EPUB and Kindle. Book excerpt: The causes, consequences and control of land use change have become topics of enormous importance in contemporary society. Not only is urban land use and sprawl a hot-button issue, but issues of rural land use have also been in the headlines. Policy makers and citizens are starting to realize that many environmental and economic issues have the question of land use at their very core. Comprising papers from a conference sponsored by the Northeast Regional Center for Rural Development, Land Use Problems and Conflicts draws together some of the most up-to-date research in this area. Sections are devoted to problems in the United States and Europe, the consequences of such problems, land use-related data and alternative solutions to conflict. With a lineup including some of the best scholarship on this subject to date, this volume will be of use to those studying environmental and land use issues in addition to policy makers and economists.

Book excerpt: This dynamic casebook focuses on the role of the lawyer in land use regulatory matters and the factors that influence land development decisions. It emphasizes the current practice of land use law and cutting-edge urban planning and sustainable development legal and policy issues. The Fourth Edition introduces a wealth of new cases and materials covering such diverse topics as the rights of religious landowners, recent takings law, the effects of the fiscal crisis on local and municipal land use regulations, regulation of green energy projects and other environmental land-use issues, local zoning to regulate marijuana dispensaries and the continuing ethical challenges in the administration of local land use regulations. Thoroughly updated, the revised Fourth Edition presents: The continuing development of the "public use" question in takings law after Kelo, including the legal disputes over when land is sufficiently andquot;blightedandquot; to legally support programs by redevelopment agencies, as in the New York Goldstein and Kaur decisions, and the Supreme Court's most recent takings decision, Stop the Beach Renourishment. he intersection of land use and First Amendment rights, particularly the interplay with the Free Exercise and Establishment Clauses. The steady flow of cases interpreting the rights of religious landowners under the Religious Land Use and Institutionalized Persons Act. The effects of the fiscal crisis on local government land use regulations. The land use effects of "shrinking" cities. Land use regulation of green energy projects, particularly the siting of windmill farms and transmission line corridors. Municipal land use policies that will limit greenhouse gas emissions and implement sustainable development, such as transit-oriented projects. The development of hybrid "public-private" communities that use a combination of common law and public regulations. The effects of using development agreements. The continuing ethical challenges in the administration of local land use regulation. Developments in planning and zoning, such as local zoning to regulate marijuana dispensaries.

Available in PDF, EPUB and Kindle. Book excerpt: This original contribution to the field is the first to bring economic sociology theory to the study of federal land exchanges. By blending public choice theory with engaging case studies that contextualize the tactics used by land developers, this book uses economic sociology to help challenge the under-valuation of federal lands in political decisions. The empirically-based, scholarly analysis of federal-private land swaps exposes serious institutional dysfunctions, which sometimes amount to outright corruption. By evaluating investigative reports of each federal agency case study, the book illustrates the institutional nature of the actors in land swaps and, in particular, the history of U.S. agencies’ promotion of private interests in land exchanges. Using public choice theory to make sense of the privatization of public lands, the book looks in close detail at the federal policies of the Bureau of Land Management and the U.S. Forest Service land swaps in America. These pertinent case studies illustrate the trends to transfer federal lands notwithstanding their flawed value appraisals or interpretation of public interest; thus, violating both the principles of equality in value and observance of specific public policy. The book should be of interest to students and scholars of public land and natural resource management, as well as political science, public policy and land law.
