It explains that aboriginal customary law can be a source of common law title to land in former British colonies, whether they were acquired by settlement or by conquest or cession from another colonising power. The doctrine of Common Law Aboriginal Customary Title provides a coherent approach to the source, content, proof and protection of Aboriginal land rights which overcomes problems arising from the law as currently understood and leads to more just results. The doctrine's applicability in Australia, Canada and South Africa is specifically demonstrated. While the jurisprudential underpinnings for the doctrine are consistent with fundamental common law principles, the author explains that the Australian High Court's decision in Mabo provides a broader basis for the doctrine: a broader basis which is consistent with a re-evaluation of case-law from former British colonies in Africa, as well as from the United States, New Zealand and Canada. In this context, the book proffers a reconceptualisation of the Crown's title to land in former colonies and a reassessment of conventional doctrines, including the doctrine of tenure and the doctrine of continuity. 'With rare exceptions ... the existing literature does not probe as deeply or question fundamental assumptions as thoroughly as Dr Secher does in her research. She goes to the root of the conceptual problems around the legal nature of Indigenous land rights and their vulnerability to extinguishment in the former colonial empire of the Crown. This book is a formidable contribution that I expect will be influential in shifting legal thinking on Indigenous land rights in progressive new directions.' They point out that even when researchers are working toward benevolent goals, environmental science and activism are often premised on a colonial worldview and access to land. Focusing on plastic pollution, the book models an anticolonial scientific practice aligned with Indigenous, particularly Métis, concepts of land, ethics, and relations. Liboiron draws on their work in the Civic Laboratory for Environmental Action Research (CLEAR)—an anticolonial science laboratory in Newfoundland, Canada—to illuminate how pollution is not a symptom of capitalism but a violent enactment of colonial land relations that claim access to Indigenous land. Liboiron's creative, lively, and passionate text refuses theories of pollution that make Indigenous land available for settler and colonial goals. In this way, their methodology demonstrates that anticolonial science is not only possible but is currently being practiced in ways that enact more ethical modes of being in the world.

Book excerpt: Drawing on two decades of ethnographic research in Sulawesi, Indonesia, Tania Murray Li offers an intimate account of the emergence of capitalist relations among indigenous highlanders who privatized their common land to plant a boom crop, cacao. Spurred by the hope of ending their poverty and isolation, some prospered, while others lost their land and struggled to sustain their families. Yet the winners and losers in this transition were not strangers—they were kin and neighbors. Li's richly peopled account takes the reader into the highlanders' world, exploring the dilemmas they faced as sharp inequalities emerged among them. The book challenges complacent, modernization narratives promoted by development agencies that assume inefficient farmers who lose out in the shift to high-value export crops can find jobs elsewhere. Decades of uneven and often jobless growth in Indonesia meant that for newly landless highlanders, land's end was a dead end. The book also has implications for social movement activists, who seldom attend to instances where enclosure is initiated by farmers rather than coerced by the state or agribusiness corporations. Li's attention to the historical, cultural, and ecological dimensions of this conjuncture demonstrates the power of the ethnographic method and its relevance to theory and practice today.

The term “recognition” shapes debates over Indigenous cultural distinctiveness, Indigenous rights to land and self-government, and Indigenous peoples’ right to benefit from the development of their lands and resources. In a work of critically engaged political theory, Glen Sean Coulthard challenges recognition as a method of organizing difference and identity in liberal politics, questioning the assumption that contemporary difference and past histories of destructive colonialism between the state and Indigenous peoples can be reconciled through a process of acknowledgment. Beyond this, Coulthard examines an alternative politics—one that seeks to revalue, reconstruct, and redeploy Indigenous cultural practices based on self-recognition rather than on seeking appreciation from the very agents of colonialism. Coulthard demonstrates how a “place-based” modification of Karl Marx’s theory of “primitive accumulation” throws light on Indigenous–state relations in settler-colonial contexts and how Frantz Fanon’s critique of colonial recognition shows that this relationship reproduces itself over time. This framework strengthens his exploration of the ways that the politics of recognition has come to serve the interests of settler-colonial power. In addressing the core tenets of Indigenous resistance movements, like Red Power and Idle No More, Coulthard offers fresh insights into the politics of active decolonization.
