Ses droits sont alors véritablement garantis, après la déclaration officielle que l’accusé est coupable, certes davantage pour lui accorder une réparation effective que pour l’associer à la peine infligée. Ces constats convergent rationnellement vers la proposition de consacrer une action civile internationale en droit international pénal. L’enjeu est alors de définir la victime d’un crime international afin de n’attribuer cette qualité qu’aux personnes de droit privé qui allèguent un préjudice suffisamment légitime. La fonction de la victime doit enfin être déterminée dans le système mondial de politique criminelle pour conclure qu’elle joue d’ores et déjà le rôle d’une partie civile véritable, par la voie subsidiaire de l’intervention. Elle devient donc un sujet du procès pénal international dans lequel elle agit pour faire reconnaître toutes les conséquences du préjudice souffert. L’action civile internationale présente ainsi deux visages autonomes mais indissociables, l’un répressif, l’autre réparateur : la contribution à l’établissement de la réalité des faits, dans l’exercice d’une forme de vindication ; et la recherche d’une forme de rétablissement, à travers une mesure de réparation ; sans oublier bien entendu le besoin complémentaire pour la victime d’obtenir protection et assistance.

The newly formed African group consists of judicial experts with both academic and practical background from various parts of Sub-Saharan Africa. The importance of such a group for the African continent cannot be overestimated. Africa plays a vital role in international criminal law and justice, both as an active player at the ICC and at the regional and national level. This book contains some of the papers that were presented at the first meeting of the newly formed African Expert Study Group on International Criminal Law/ Groupe des Experts Africaines en Droit Pénal International held in September 2011 in Brussels, Belgium. The group was established under the auspices of the Multinational Development Policy Dialogue (hereinafter 'MDPD') and the Rule of Law programme of the German Konrad-Adenauer-Stiftung ('KAS') in 2010 modeled on the successful sister group in Latin America. This latter group was originally founded as an expert group to monitor the implementation of the Rome Statute of the International Criminal Court ('ICC') in Latin America within the framework of cooperation between KAS' regional Rule of Law Programme and the Department for Foreign and International Law of the Institute for Criminal Law and Criminal Justice of the Georg-August-Universität Göttingen in 2002. The newly formed African group consists of judicial experts with both academic and practical background from various parts of Sub-Saharan Africa. The importance of such a group for the African continent cannot be overestimated. Africa plays a vital role in international criminal law and justice, both as an active player at the ICC and at the regional and national level. As for the group's composition and outreach, the aim is to broaden regional representation and further consolidate membership. In 2012, the group will meet in Nairobi, Kenya to deal with topics surrounding the 'Potential for the domestic prosecution of international crimes in Africa.' Topics for future meetings abound given the multi-faceted African legal and political practice regarding international criminal justice in general and the ICC in particular. The group should in particular monitor the recent international or transnational criminal justice developments at the regional African level as well as relevant national developments. Understanding more and better is at the basis of knowledge creation and extension. One way of getting access to how understanding comes about and how knowledge is the result of a continuous dynamics of understanding and misunderstanding is by studying the cognitive potential and the development of natural language(s) and more particularly of terminology, in specialized domains. In this volume on dynamics and terminology, thirteen contributors illustrate that human cognition is a dynamic process in a variety of socio-cognitive and cultural settings. The case studies encompass a panoply of methodologies and deal with subjects ranging from the dynamics of legal understanding in multilingual Europe, over financial, economic and scientific terminology in several cultural and linguistic settings, to language policy issues in multilingual environments. All thirteen contributors link the dynamics of cognition to the creative potential of language as a repository of past and present experience in cultural settings and to the creation of neologisms in domain-specific languages. Attention is given to the functionality of indeterminacy, vagueness, polysemy, ambiguity, synonymy, metaphor and phraseology. In this volume terminology is researched and discussed from an interdisciplinary perspective, combining insights developed over the last decades in communicative terminology, socio-terminology, socio-cognitive terminology, cultural terminology, with tools and methods from cognitive linguistics, corpus linguistics, sociolinguistics, frame semantics, semiotics, knowledge engineering and statistics.
