Book excerpt: A l’heure où l’on peut tout acheter ou presque sur Internet (nourriture, vêtements, voitures, appartements,...), alors que la télémédecine1 voit le jour dans certaines parties du globe, et que près d’un français sur trois a déjà consulté Internet pour obtenir des informations en matière de santé (1), quoi de plus normal que de pouvoir commander des médicaments sur la toile ? Pourtant le médicament est loin d’être un banal produit de consommation et son arrivé dans le monde du commerce en ligne fait polémique. Mais déjà depuis 2003 et l’arrêt Doc Morris, les pays européens sont de plus en plus nombreux à autoriser cette pratique. Et la pression européenne réclamant une harmonisation entre les pays membres sur le sujet s’est faite plus pesante ces dernières années incitant la France à faire évoluer sa législation en faveur du commerce électronique des produits de santé (Directive 2011/62/UE du 8 juin 2011 du parlement européen). En l’absence d’un cadre juridique sur la question depuis un certain nombre d’années, en France, un pharmacien s’est engouffré dans la brèche en novembre 2012. Il s’est immédiatement attiré les foudres des associations de pharmaciens nationales. Pourtant, suite à son initiative, la vente en ligne des médicaments non soumis à prescription médicale est finalement autorisée en France (ordonnance 2012-1427 et le décret 2012-1562). Dès lors, le pharmacien peut légitimement s’interroger sur la manière de créer un site Internet pour son officine et sur le contenu qu’il peut présenter au public. Plusieurs sociétés proposent aujourd’hui la livraison de site clé en main pour le pharmacien. Mais leurs offres, bien que semblant proches, ne sont pas toujours équivalentes. Quelques particularités peuvent aider à choisir l’une plus que l’autre selon ce que le pharmacien souhaite présenter sur son site.

En France et en Europe, le système sanitaire obéissant à un autre modèle, le cheminement se fait de manière plus prudente.

En effet, la France est un pays particulièrement épargné par la contrefaçon de médicaments grâce à une chaîne de distribution performante, sécurisée et efficace, ainsi qu’à un système de protection sociale efficient. Internet est cependant un espace illimité difficile à contrôler et à maîtriser, où la sécurité est difficile à garantir. L’établissement du cadre légal de la vente en ligne tente ainsi de faire corréler au mieux les exigences de sécurité de la chaîne du médicament à l’espace internet. Deux ans après la mise en place de la vente de médicaments sur internet, celle– ci représente finalement une très faible partie des sites internet de pharmacies en ligne aujourd’hui. Les pharmaciens ont aussi trouvé dans l’outil internet l’opportunité de proposer des services adaptés aux patients – internautes d’aujourd’hui, permettant de s’interroger sur la place des sites internet d'officines et leur encadrement.
