La necesidad ontológica contenida en la tesis de que el Derecho es conducta humana, nos revierte a esta intuición de la persona y la despliega a la vez que sin agregarle nada, sin privarla de nada. La teoría egológica comporta consecuencias considerables para la técnica jurídica. No podía ser de otra manera dada la magnitud efectiva de su innovación teorética. Los juristas están habituados a señalarse grandes discrepancias teóricas que carecen de consecuencias prácticas; viven separados por las doctrinas y unidos en la práctica, aunque sin entender esta paradoja cuya naturaleza ideológica es patente en la medida en que cada uno solo está defendiendo a su manera un mismo statu quo. La teoría egológica le hace ver al juez que, cuando dicta su sentencia, no es neutral porque de hecho no puede serlo. Le hace ver también que no puede ser indiferente porque está viviendo una preferencia. La teoría egológica le desoculta al juez la naturaleza ineludible de su compromiso vital, en la sola forma que esto no se refuta, a saber: haciéndole temático lo que él vive en sus sentencias. Esto quiere decir también y muy especialmente, que no le lava las manos, sino que lo empuja a definir su destino en lo que le tocare hacer, es decir, que lo llama a vivir con autenticidad". Established as an affiliate society of the World Institute for Ad vanced Phenomenological Research and Learning in 1976, in Arezzo, Italy, by the president of the Institute, Dr Anna-Teresa Tymieniecka, this particular society is devoted to an exploration of the relevance of phenomenological methods and insights for an understanding of the origins and goals of the specialised human sciences. The essays printed in the first part of the book were originally presented at the Second Congress of this society held at Purdue University, West Lafayette, Indiana, 12-14 July 1979. The second part of the volume consists of selected essays from the third convention (the Eleventh International Congress of Phenomenology of the World Phenomen ology Institute) held in Cambridge, Massachusetts in 1981. With the third part of this book we pass into the "Human Rights" issue as treated by the World Phenomenology Institute at the Interamerican Philosophy Congress held in Tallahassee, Florida, also in 1981. The volume opens with a mono graph by Anna-Teresa Tymieniecka on the foundations of ethics in the moral practice within the life-world and the social world shown as clearly distinct. The main ideas of this work had been presented by Tymieniecka as lead lectures to the three conferences giving them a tight research-project con sistency.

Book excerpt: This is the English version of Jerzy Wroblewski's major work in Polish, S~dowe Stosowania Prawa (translated in his own preferred terms as 'The Judicial Application of Law'). The present translation arose out of a visit by the author to Scotland in 1989. In that year, the Carnegie Trust for the Universities of Scotland made it possible for Jerzy Wroblewski to spend six months as a Carnegie Fellow in the Centre for Criminology and the Social and Philosophical Study of Law at the University of Edinburgh. During that time he took a notably active part in the intellectual life of the Centre and the Faculty of Law. He gave freely of his time in teaching and advising students and also produced a series of original articles on topics connected with legal reasoning and law and computers. His major task while he was here, however, was to prepare a translation of S~dowe Stosowania Prawa, and this he accomplished to the extent of completing a preliminary draft. Zenon Bankowski and Neil MacCormick were to help him in improving this linguistically and preparing the final text for publication. Wroblewski warned us, having finished his draft with great labour, that the greater labour would be in the polishing of it. For we would have, as he joked, 'to translate my English into English'. And certainly, we found it extremely time-consuming, so as to defy completion during his stay in Edinburgh.
