Book excerpt: El agua es un bien desde siempre necesario para la vida, pero, aunque los recursos de agua potable son finitos, alrededor de setecientos cuarenta millones de personas carezcan de acceso a la misma y dos mil cuatrocientos millones no dispongan de infraestructuras de saneamiento a mediados de la segunda década del siglo XXI, el reconocimiento del derecho humano al agua les ampara-formalmente- desde hace poco tiempo. Tal derecho es, en efecto, un logro reciente de nuestro siglo: no estaba previsto en la Declaración Universal de 1948, ni apareció tampoco en el Pacto Internacional de los Derechos Humanos Económicos, Sociales y Culturales aprobado en 1966. La demanda de que se corrigiera este olvido fue aumentando a medida de que se tomó conciencia del desproporcionado crecimiento del consumo de agua- dos veces superior al de la tasa de crecimiento de la población- del elevado estrés hídrico de amplias zonas del Planeta y de la peligrosa y creciente reducción del agua dulce potable como consecuencia del cambio climático, la sobreexplotación de los acuíferos, su desperdicio y contaminación en los países desarrollados o en vías de desarrollo, así como de la carencia de infraestructuras y tecnología para su extracción y conducción hasta los consumidores en los países subdesarrollados. El artículo I.1 de la Observación General nº 15 del Comité de Derechos Económicos, Sociales y Culturales de la ONU estableció en el año 2002 que "El derecho humano al agua es indispensable para una vida humana digna" haciéndolo derivar del derecho a la alimentación y a la salud. El 28 de julio de 2010 la Asamblea General de las Naciones Unidas aprobó, tras muchas inclusiones tangenciales u ocasionales de referencias a dicho derecho en diversos instrumentos internacionales, la Resolución 64/292 que establecía de forma explícita el derecho humano al agua y al saneamiento, ambos esenciales para la realización de todos los demás derechos humanos, y hacía un llamamiento a los Estados y las Organizaciones Internacionales para que proporcionaran recursos, tecnología y formación que aseguraran a todas las personas acceso a la misma, resolución que fue refrendada por otra del Consejo de Derechos Humanos de la ONU en septiembre de 2010. Este trabajoso logro, que contó con la oposición de algunos países, como los EE.UU, se vio empañado por los intentos de los gestores políticos para resolver la carencia de recursos financieros para efectuar las obras que aseguren la disponibilidad, control de calidad y depuración del preciado líquido, cuando se les conmina a ello, cuando no para lucrarse, privatizando su canalización, control y distribución y por los intentos empresariales de acumular cuantiosos beneficios aprovechando esta circunstancia, lo que añade a las dificultades para resolver las carencias, en zonas de estrés hídrico, el riesgo de que las soluciones buscadas provoquen su encarecimiento y el de una distribución aún más desigual que la ya existente. Las corporaciones multinacionales, a veces a golpe de sobornos y comisiones, otras utilizando sus redes de relaciones e influencias, están recibiendo concesiones alarmantes de explotación y gestión del agua o logrando autorizaciones para efectuar grandes construcciones o conductos con el fin de proporcionar su abastecimiento oneroso a ciertas poblaciones, con el beneplácito y apoyo del Banco Mundial y la Organización Mundial del Comercio. La sociedad civil comienza a movilizarse también contra las prácticas de mercantilización. En fechas recientes, tras una masiva recogida de firmas para presentar a la UE una petición - denominada "Iniciativa Ciudadana Europea" (ICE), esta ICE logró que la Comisión de Medio Ambiente del Parlamento Europeo respaldase la gestión pública del agua, reconociendo que su condición de derecho humano así lo requería (RIGHT2WATER). Pero no todas la áreas del Planeta, ni todos los colectivos, disponen de un derecho de democracia participativa trasnacional como el entrañado por la ICE, ni todos se benefician de la Cooperación Internacional (el África Subsahariana es la gran olvidada de la ayuda internacional), ni tienen la misma capacidad o emplean las mismas formas de resistencia a los abusos cometidos con la gestión del agua, de modo que o el abuso o el conflicto están servidos.
