Sa réglementation résulte principalement de conventions internationales. Celles-ci ont été élaborées et adoptées dans le but d'offrir aux acteurs une prévisibilité et une unification du droit. L'éclatement des règles applicables aux contrats de transport maritime de marchandises prouve la paralysie de l'unification, en créant des problèmes juridiques inédits. Dans ces conditions, une étude de conflits de lois et des conventions internationales portant sur cette matière devenait utile pour tenter de dresser un état du droit positif dans la perspective de rechercher la prévisibilité des solutions. Le terme« unification» révèle un objectif, considéré par beaucoup comme idéal. Or, le but visé au début du XXème siècle, quant à la mise en place d'une convention à vocation universelle reste d'actualité à notre époque où règne encore une certaine confusion en droit du transport maritime de marchandises. Consciente de la superposition antagoniste des conventions internationales sur le transport maritime de marchandises, la conférence des Nations Unies sur le droit commercial international (CNUDCI) a adopté en juillet 2008 un projet «sur le transport international de marchandises entièrement ou partiellement par mer ». Cette démarche nous parait utile. On peut se demander si la nouvelle convention est susceptible de jouer efficacement son rôle de système moderne et cohérent de régime juridique du contrat de transport maritime international de marchandises. La nouvelle convention est ambitieuse. Sera-t-elle la convention de XXIème siècle? Où bien sera-telle un facteur de division qui s'ajoute à la confusion?

L'idée est de permettre la création d'un commerce méditerranéen qui s'affranchirait des obstacles technique non tarifaires constitués par la fragmentation des systèmes juridiques. En effet, il ne s'agit pas là, de créer une législation commune entre les 43 pays de l'Union pour la Méditerranée, afin de rapprocher leur culture juridique, mais de mettre en place une harmonisation du droit des transports maritimes, permettant de mieux surmonter les obstacles, disparités, à la mise en place d'un marché commun. Mais quels peuvent être ces obstacles ? Il s'agit des normes tarifaires, des tarifs douaniers... mais également juridiques. Ainsi, peut-on admettre ou prévoir une harmonisation des transports maritimes, ayant une incidence sur le commerce méditerranéen ? Constitue-t-il un îlot de résistance au même titre que le droit fiscal ou le droit social ? Il apparaît certes qu'on peut l'harmoniser. En effet, le transport maritime s'apparente comme l'outil permettant la libre circulation des marchandises dans un ensemble commun. C'est de cette manière que l'Union européenne s'est construite. D'ailleurs, ne s'agit- il pas d'un domaine déjà harmonisé entre ces pays ? Il faut sa-voir, qu'avant la mise en place d'une Union pour la Méditerranée, il existait de nombreuses conventions et organisations promouvant une harmonisation dans ce domaine. En somme la méditerranisation des transports maritime requiert la méditerranisation des règles juridiques qui l'encadrent.

The advantages of electronic bills of lading are many, including lower cost, higher efficiency, improved security, and speedier delivery of goods at the end of the voyage (the collection of reports focus upon bills of lading for the international carriage of goods by sea). According to the contributors, the use of electronic bills of lading is, essentially, a business rather than a legal decision. The law may provide the legal framework for the function of electronic bills of lading in the same way and with the same effects as the traditional bills of lading. However, business interests will eventually determine whether the availability of, and the economic incentives for, the use of the electronic bills of lading outweigh concerns for privacy and the safeguarding of trade secrets, for accuracy of information, and for security transactions and acquisition. Such concerns call for technological rather than legal solutions. This book ahould appeal primarily to practitioners who are interested in economics and commerce.
