Prior to Quebec's "Quiet Revolution" of the 1960s, local governments in Montreal both reflected and perpetuated the mutual isolation of French and English. Residential concentration in autonomous suburbs, together with self-contained networks of schools and social services, enabled English-speaking Montrealers to control the city's economy and to conduct their community's affairs with little regard for the French-speaking majority. The modernization of the Quebec state in the 1960s dramatically challenged this arrangement. The author demonstrates how the English-speaking politicians in cooperation with certain French-speaking allies have succeeded in preventing the wholesale adoption of ambitious schemes for metropolitan reorganization. He describes the workings of a society divided by language and ethnicity, where the pervasiveness of the politics of language impedes all plans for comprehensive metropolitan reform. By 1949, five provinces had constitutionally protected denominational schools. The federal government’s responsibility for the education of Indigenous Peoples was effectively contracted out to the churches for more than a century, resulting in a history of abuse that has only recently come to light. From the 1950s to the 1970s, several initiatives in different provinces set the stage for significant reforms to education. Some of these tested the limits of denominational protections, but could not shake the underlying constitutional structures. Patriation of the Constitution and adoption of the Canadian Charter of Rights and Freedoms in 1982 codified fundamental changes in thinking about civil rights. The Charter allowed existing denominational rights to be challenged on many fronts. However, all such challenges were rebuffed by the courts on the grounds that the Charter cannot be used to override other parts of the Constitution. By the 1990s, it became apparent that another route to reform was available, through the amending formula. Constitutional amendments were used to end denominational control of schools in Newfoundland and Quebec in 1997 and 1998. The circumstances around those constitutional amendments are discussed in detail as possible precedents for similar outcomes in Alberta, Ontario, and Saskatchewan. This book contends that change will certainly come to these provinces and several paths to reform are explored. This reform aims to remove the discrimination inherent in denominational institutions while preserving some form of religious involvement in certain schools.

Book excerpt: The Canadian principle of reasonable accommodation demands that the cultural majority make certain concessions to the needs of minority groups if these concessions will not cause 'undue hardship.' This principle has caused much debate in Quebec, particularly over issues of language, Muslim head coverings, and religious symbols such as the kirpan (traditional Sikh dagger). In 2007, Quebec Premier Jean Charest commissioned historian and sociologist Gérard Bouchard and philosopher and political scientist Charles Taylor to co-chair a commission that would investigate the limits of reasonable accommodation in that province. Religion, Culture, and the State addresses reasonable accommodation from legal, political, and anthropological perspectives. Using the 2008 Bouchard-Taylor Report as their point of departure, the contributors contextualize the English and French Canadian experiences of multiculturalism and diversity through socio-historical analysis, political philosophy, and practical comparisons to other jurisdictions.
