Au premier rang se trouve la directive du 25 juillet 1985, dont l'étude permet de situer la position dans la hiérarchie des normes et de préciser l'état de sa transposition dans les différents états membres. Par la suite, les deux parties principales sont exclusivement consacrées à la responsabilité du fait des produits en droit interne français. La première partie envisage la notion de responsabilité du fait des produits. De par ses caractéristiques propres, elle se détache de notions voisines, tels que les régimes de responsabilité et les obligations qui les fondent. De plus, cette même notion possède un propre domaine d'application qui est soigneusement délimité, à savoir les choses pouvant être considérées comme des produits, les victimes bénéficiant de ce régime, les personnes tenues pour responsables et enfin, les dommages couverts par les nouvelles dispositions. La deuxième partie aborde le régime de la responsabilité du fait des produits proprement dit. D'une part, ce régime dépend de conditions constituant le système légal de cette responsabilité, même si les parties peuvent l'aménager par le biais de modifications conventionnelles. D'autre part, l'étude de sa mise en oeuvre exige, en cas d'intervention d'éléments d'extraneite, de prendre en considération la compétence internationale tant de la loi que de la juridiction compétente. De plus, la spécificité de ce régime implique un traitement judiciaire spécial pour l'action de la victime devant le tribunal. Enfin, les risques encourus par les producteurs et l'ampleur du montant des réparations sont étudiés dans les moyens collectifs d'indemnisation des victimes par un tiers.

Cette étude se propose de réaliser la synthèse des règles de droit en vigueur en France et en Angleterre, et de déterminer quelles règles peuvent faire apparaître une obligation de sécurité des produits, d'en rappeler le contenu et le régime juridique, et également de préciser comment ces différentes règles s'agencent entre elles. La distinction entre responsabilité contractuelle et délictuelle permet de comparer les moyens et le niveau de protection selon que le produit ayant causé le préjudice avait fait l'objet d'un contrat passé par la victime ou non. Elle se justifie parce qu'elle subsiste dans les droits français et anglais malgré l'adoption des textes du droit européen, qui ont pour but de supprimer cette distinction. En dépit des différences dans les raisonnements et les cultures juridiques des deux pays, on peut conclure à une certaine convergence des solutions en pratique : la diversité des règles en vigueur permet d'indemniser les victimes des produits défectueux de manière quasi-systématique en France comme en Angleterre.
