Le logiciel est qualifié d'oeuvre de l'esprit d'après la loi de 1985. Les règles traditionnelles de la responsabilité civile s'appliquent donc car il n'existe pas de dispositions spécifiques concernant la responsabilité civile en matière de propriété intellectuelle. Selon ces règles, il faut prouver la faute, le préjudice et le lien de causalité pour indemniser les victimes.Face à ces difficultés, la question fondamentale qui se pose est de savoir : si on peut bénéficier du progrès réalisé par la loi française du 19 mai 1998 sur la responsabilité du fait des produits défectueux. En réalité, cette loi adopte une responsabilité objec ive pour indemniser les victimes des produits défectueux. C'est pourquoi, l'application des règles de cette loi est inefficace en la matière.
