Les problèmes juridiques posés par le développement de systèmes d'intelligence artificielle sont de deux ordres : ils concernent d'une part la définition juridique de l'intelligence artificielle. En tant qu'outil technique, source potentielle de fait juridique, son étude et sa qualification implique un nécessaire effort de définition. Au-delà des définitions scientifiques proposées, cette thèse s'attache d'abord à définir juridiquement la notion de système d'intelligence artificielle afin d'embrasser la réalité technique contemporaine ainsi que les possibles innovations futures. D'autre part, le présent travail de recherche dresse un état des régimes susceptibles d'être appliqués aux systèmes d'intelligence artificielle. Dans quelle mesure le recours à un système d'intelligence artificielle est-il permis ? Sur quel fondement peut-on réparer le dommage né de l'action d'un système d'intelligence artificielle ? Quelle part de responsabilité détiennent concepteurs, fournisseurs et utilisateurs ? Ces questions, qui présentent déjà une certaine actualité, seront au cœur des réflexions des juristes confrontés à la généralisation de nouveaux systèmes intelligents.
