Book excerpt: This book explores the reactions to Europeanization and globalization in times of economic distress, including the transformation of European values in national legal cultures. The authors explore how European values, tradition and new legal challenges interconnect and dictate the paths of transition between old and new Europe. The first chapter starts with a question: can Roman Legal Tradition play a role of identity factor towards a New Europe? Can it be considered as a general value identifying new Europe, built on a minimum core of principles – persona, dominum, obligation, contract and inheritance – composing the whole European private law tradition? Subsequent chapters attempt to provide possible responses to the question: what is Europe today? The answers diverge, depending on the research area. The inherent dichotomy of human rights protection in Europe and the concept of ‘one law, one court’ are investigated in the second chapter, whereas the third chapter focuses on asylum and the interrelation and interdependence of the Court of Justice of the EU and the European Court of Human Rights. The next three chapters concentrate on matters of equal treatment and non-discrimination. The first contribution in this part reflects on the crisis and methodological and conceptual issues faced by modern anti-discrimination law. It is followed by a specific analysis of the empowerment of women or gender-balancing in company boards. The third contribution reveals the impact of the Croatian anti-discrimination law on private law relations. The next chapter deals with the issue of social rights in Croatia and the method of their regulation in the context of the new European values. The immense challenges posed by the market integration imperative and democratic transition have brought about different reactions in the national legal systems and legal cultures of both old and new Member States. As such, Europe has effectively been reunited, but what about the convergence of national legal cultures? This is the focal point of the remaining chapters, which focus on various issues, from internal market, competition law, consumer welfare, liberalization of network industries to the EU capital market. The magnitude of EU activity in these areas offers conclusive evidence that old and new paradigms are evolving and shaping the future of the EU.

Meanwhile, methods of analysis have significantly evolved, principally due to computer applications and new ways of thinking and approaching old problems. Thus, it becomes necessary to come up with a new scientific approach to tackle management and engineering aspects of railways, to understand in-depth the origins and inter-relationships of the various situations and phenomena and to suggest the appropriate methods and solutions to solve the various emerging problems. This book aims to cover the need for a new scientific approach for railways. It is intended to be of use to railway managers, economists and engineers, consulting economists and engineers, students of schools of engineering, transportation, economics, and management. The book is divided into three parts, which deal successively with management, track, and rolling stock, environment and safety. Each chapter of the book contains the necessary theoretical analysis of the phenomena studied, the recommended solutions, applications, charts and design of the specific railway component. In this way, both the requirement for a theoretical analysis is met, and the need of the railway manager and engineer for tables, nomographs, regulations, etc. is satisfied. Railways in Europe have separated activities of infrastructure from those of operation. In other parts of the world, however, railways remain unified. The book addresses both situations (separated and unified railways). Railways present great differences in their technologies. Something may be valid for one such technology, but not for another. To overcome this problem, regulations of the International Union of Railways (UIC) as well as European Standardization (CEN) and European Technical Specifications for Interoperability (TSIs) have been used to the greatest extent possible. Whenever a specific technology or method is presented, the limits of its application are clearly emphasized.

Future generations may well see this as a major turning point, opening the way to radical changes in diagnosis, prognosis, and medical treatment. Often compared with the space programme, this vast enterprise still generates misgivings: this new power, which human beings now have, to modify the genetic heritage of living creatures raises fundamentally new ethical questions - and society as a whole will have to find the answers. In fact, the accelerating pace of scientific and technical progress seems to be reviving atavistic anxieties, some rational, others less so. Recent public-health crises, including the mad cow disease' scare, which lasted into 2000, have fuelled these fears. The public's rejection of GMOs (Genetically Modified Organisms) - verging on a crusade in some countries - tells its own story. As regards conflict, 2000 saw the Middle East peace process grind to a halt, and the Intifada resume. In Europe, the situation in Kosovo and Chechnya, both the scenes of fighting in 1999, stayed precarious. Peace and democracy did score some successes, however, particularly in Europe: the centre-left's victory in Croatia, sweeping former President Tudjman's party off the scene, the democratic party's triumph in Bosnia, and the fall of the Milosevic regime in Serbia.
