Book excerpt: In 2020, as Latin American countries shuttered their economies, it became clear that effective lockdowns would require states to provide income support. In a region that has historically struggled to build systems of social protection, the effort to expand benefits was notable. Policies varied in scope and generosity, but in what seemed to signify a new era of state-building, Latin American democracies demonstrated a nearly uniform commitment to providing assistance to the poor. Why did some countries implement broader and more adequate programs than others and why did countries vary in their ability to sustain support over time? This Element argues that three factors explain cross-national and cross-temporal differences in policy effort: policy legacies, unified/divided government, and fiscal space. The study shows that in settings of crisis, the democratic politics of social policy expansion shift, with traditional factors like ideology and electoral competition playing a less central role.

In the last decade, five Eurozone governments in economic difficulty received assistance from international lenders on the condition that certain policies specified in the Memoranda of Understanding were implemented. How did negotiations take place in this context? What room for manoeuvre did the governments of these countries have? After conditionality, to what extent were governments willing and able to roll back changes imposed on them by the international lenders? This book explores the constraints on national executives in the five bailed out countries of the Eurozone during and beyond the crisis, from 2008 to 2019. The authors argue that despite international market pressure and creditors’ conditionality, governments had some room for manoeuvre during a bailout and were able to advocate, resist, shape or roll back some of the policies demanded by external actors. Under certain circumstances, domestic actors were also able to exploit the constraint of conditionality to their own advantage. Capitalising on constraint shows that after a bailout programme, governments could use their discretion to revert the measures that brought the greatest benefits at a lower cost. The authors provide a valuable insight into the determinants of bargaining leverage, the importance of credibility, and the limits of conditionality that might inform the design of international and European lending during future crises.

The balancing of constitutional labour rights can be conducted by various institutional actors and by applying different techniques. This volume reviews the theoretical debates on judicial balancing and the approaches adopted by the Court of Justice of the European Union and the European Court of Human Rights, to proceed with a closer assessment of Italian and Spanish judicial traditions. In particular, it addresses the main profiles of the case law of the Italian and Spanish Constitutional Courts on labour and social law reforms adopted in the aftermath of the 2008 crisis, where balancing takes place between labour rights and economic principles. The analysis is focused on four main aspects: the fundamental labour rights in the balance; the role of the Courts; the technique applied by the Judges; and the constitutional interests subject to the balancing. In Building Power to Shape Labor Policy, Pablo Pérez Ahumada explains why. Focusing on reforms to collective labor law, Pérez Ahumada argues that analyzing how both workers and employers mobilize power to influence government policies is crucial for understanding labor reform outcomes. He examines the relational character of power to explain how different types of power—structural, institutional, associational—interact with each other, and proposes a relational understanding of power and how it is balanced among competing social classes. While workers and employers both have a hand in shaping labor law, their influence is not equal. Analysis of recent events in Chile reveals how the balance of power and the lingering effects of neoliberalism manifest in labor reform.
