Available in PDF, EPUB and Kindle.

Book excerpt: CETTE ETUDE PROPOSE UN ESSAI D'UNE THEORIE GENERALE DES PROBLEMATIQUES DE LA PREUVE DEVANT LA JURIDICTION INTERNATIONALE. CETTE THEORIE SERA DEGAGEE DES PRATIQUES JURIDIQUES INTERNATIONALES, NOTAMMENT, LES PRATIQUES DE LA COUR INTERNATIONALE DE JUSTICE, QUI SONT, A NOTRE AVIS, LA BASE DE CETTE THEORIE. ELLE VISE A FAIRE EVOLUER CES PRATIQUES ET COMBLER LES LACUNES EN RELATION AVEC LA NATURE DE LAJURIDICTION INTERNATIONALE. LES PROBLEMES QUI SURGISSENT A PROPOS DE LA PRESENTATION ET DE L'EVALUATION DE LA PREUVE DEVANT LA JURIDICTION INTERNATIONALE SONT NOMBREUX ET COMPLEXES. LE DROIT INTERNATIONAL DE LA PROCEDURE MANQUE DE PERENNITE ET LES REGLES QUI LE GOUVERNENT SONT TRES SOMMAIRES ET DIFFICILES A INTERPRETER. LE PROBLEME APPARAIT D'UNE MANIERE PLUS EVIDENTE LORSQUE DES TRIBUNAUX INTERNATIONAUX SE TROUVENT FACE A UNE DIFFICULTE SUPPLEMENTAIRE CAUSEE PAR LA CONFRONTATION DES REGLES DE PREUVE RETENUES PAR LES DIFFERENTS SYSTEMES JURIDIQUES. EN EFFET, LES TECHNIQUES ET LES REGLES DE PREUVE VARIENT NON SEULEMENT SELON LES SYSTEMES JURIDIQUES, MAIS AUSSI SELON LES FINALITES PROPRES A CHAQUE BRANCHE DU DROIT. LES REGLES ADOPTEES PAR LE DROIT CONTINENTAL SONT DIFFERENTES DE CELLES RETENUES PAR LE DROIT ANGLO-AMERICAIN. CETTE DIFFERENCE POSE DE SERIEUX PROBLEMES A LA JURIDICTION INTERNATIONALE, L'UNE DES PARTIES NE POURRA NI EVALUER LES PREUVES PRESENTEES PAR L'AUTRE, NI APPRECIER LEUR CONTENU. LES PARTIES TENTENT DE FAIRE PREVALOIR LEURS PROPRES REGLES NATIONALES EN MATIERE DE PREUVE ET DE LES TRANSPOSER DEVANT LA JURIDICTION INTERNATIONALE. C'EST AINSI QU'APPARAISSENT DES DIFFICULTES CAUSEES PAR LES DIFFERENCES DANS LES DIVERSES TECHNIQUES RETENUES PAR LES DROITS INTERNES. LES JUGES EMANANT DES DIFFERENTS SYSTEMES JURIDIQUES SERONT A LEUR TOUR CONFRONTES AUX MEMES DIFFICULTES ; CELA APPARAITRA D'UNE MANIERE PLUS EVIDENTE LORS DE L'EVALUATION DES PREUVES ET DE LEUR CLASSIFICATION. AFIN DE FAIRE FACE A CES DIFFICULTES, NOUS CHERCHERONS A ETABLIR UN SYSTEME VALABLE POUR LA PRESENTATION ET L'EVALUATION DES PREUVES, QUI TIENT COMPTE DE LA NATURE PROPRE DU DROIT INTERNATIONAL ET DE LA JURIDICTION INTERNATIONALE. LES REGLES DONT NOUS ALLONS ETUDIER LES MODALITES D'APPLICATION SONT PROPRES A LA PROCEDURE INTERNATIONALE, LEUR ORIGINALITE EST INDENIABLE. CETTE THEORIE NE DOIT PAS ETRE CONSIDEREE COMME LA TRANSPOSITION PURE ET SIMPLE DES REGLES APPLICABLES DEVANT LES TRIB

Available in PDF, EPUB and Kindle.

Book excerpt: This book explores how courts decide, or ought to decide, in situations of uncertainty. A Court must always decide the case before it, even if the relevant facts remain unclear. The question then arises which party benefits and which party is burdened by that uncertainty. In these cases, the Court must apply the rules on the burden of proof or, more precisely, the burden of persuasion. Their importance for the individual claimant is obvious. The comparison of two domestic systems (one based on common law and the other a traditional code-based legal order) with regard to the issue of burden of proof helps to clarify the terminology and lays the ground for dealing with the burden of proof in international human rights law. Without knowing what can be understood by the term `burden of proof' under domestic law, international lawyers with different domestic law backgrounds are in danger of misunderstanding each other. This may lead to obscuring the problems connected with court decisions involving uncertainty. The study also deals with uncertainties with regard to legislative (general) in contrast to adjudicative (individual) facts and with uncertainties in the framework of predictions in contrast to uncertainties relating to historic facts. It attempts to prepare the ground for dealing more consciously and more consistently with problems of uncertainty in international human rights law. International courts, due to their geographical and cultural distance from the case, usually have less access to the underlying facts. Nevertheless, in order to protect human rights effectively, international courts and tribunals cannot always restrict themselves to reviewing the law, but may also have to decide on the facts. Thus issues relating to decision-making on the basis of uncertain facts, including the burden of persuasion, are even more important in international than in domestic human rights law.

Book excerpt: Litigation at the International Court of Justice provides a systematic guide to questions of procedure arising when States come before the International Court of Justice to take part in contentious litigation. Quintana's approach is primarily empirical and emphasis is put on examples derived from actual practice. This book is mainly intended to help practitioners and advisors to governments engaged in actual cases and deliberately avoids theoretical discussions, favoring a pragmatic stance that is focused not so much on what authors have to say on any given topic concerning procedure, but rather on presenting, directly “from the Court’s mouth,” as it were, what ICJ judges actually have done and said over the last ninety years concerning such questions.

Book excerpt: Arbitral and judicial decisions dealing with territorial land and maritime disputes bear the mark of compromising. They draw boundaries situated between the respective pretentions of the parties and ensure an equitable share of spaces and resources. This phenomenon of compromising symptomatically appears in the jurisprudence dealing with territorial disputes, because of their specific nature, and the geostrategic, economic and emotional factors at stake. It is also due to the remarkable flexibility of applicable norms and principles, which provides a vast power of appreciation to the judge. This study enhances how the content of the decisions is used in order to reach a balanced solution and demonstrates that the international judge focuses on peacekeeping considerations.

Book excerpt: This book contains a collection of essays by leading experts linked to the outstanding characteristics of the scholar in honour of whom it is published, Tullio Treves, who combines his academic background with his practical experiences of a negotiator of international treaties and a judge of an international tribunal. It covers international public and private law related to international courts and the development of international law. Under Article 38 of its Statute, the International Court of Justice can apply judicial decisions only as a “subsidiary means for the determination of rules of law”. However, there are many reasons to believe that international courts and tribunals do play quite an important role in the progressive development of international law. There are a number of decisions which are inevitably recalled as the first step, or a decisive step, in the process of the formation of a new rule of customary international law. In these cases, can the judge be considered as a subsidiary of others? Are these cases compatible with the common belief that a judge cannot create law? Is this a peculiarity of international law, which is characterized by the existence of several courts but the lack of a legislator? Do decisions by different courts lead to the consequence of a fragmented international law? This volume provides the reader with an elaboration of various questions linked to the legislative role of courts. In their choices of subjects, some contributors have taken into account the general aspects of the development of international rules through court decisions or specific sectors of international law, such as human rights, international crimes, international economic law, environmental law and the law of the sea. Others have chosen the subject of the rules on jurisdiction and procedure of international courts. The question of the courts’ role in the development of areas of law different from public international law, namely private international law and European Union law, has also been considered. The information and views contained in this book will be of great value to academics, students, judges, practitioners and all others interested in the public and private international law aspects of the link between international courts and the development of international law.

Available in PDF, EPUB and Kindle. Book excerpt: The International Court of Justice is the principal judicial organ of the United Nations and plays a central role in both the peaceful settlement of international disputes and the development of international law. This comprehensive Commentary on the Statute of the International Court of Justice, now in its second edition, analyses in detail not only the Statute of the Court itself but also the related provisions of the United Nations Charter as well as the relevant provisions of the Court's Rules of Procedure. Five years after the first edition was published, the second edition of the Commentary embraces current events before the International Court of Justice as well as before other courts and tribunals relevant for the interpretation and application of its Statute. The Commentary provides a comprehensive overview and analysis of all legal questions and issues the Court has had to address in the past and will have to address in the future. It illuminates the central issues of procedure and substance that the Court and counsel appearing before it face in their day-to-day work. In addition to commentary covering all of the articles of the Statute of the ICJ, plus the relevant articles of the Charter of the United Nations, the book includes three scene-setting chapters: Historical Introduction, General Principles of Procedural Law, and Discontinuation and Withdrawal. The second edition of the Commentary adds two important and instructive chapters on Counter-Claims and Evidentiary Issues. The combination of expert editors and commentators, and their assessment of new developments in the important work of the ICJ, make this a landmark publication in the field of international law.

Book excerpt: International investment arbitration has been dubbed the “Antarctica” of international procedural law. This book explores international investment arbitration (IIA) using the searchlight of comparative analysis. Further, it provides answers to several questions, such as the role of ICJ judgments and WTO decisions as a source of inspiration for how proof and the burden of proof are approached in IIA. By investigating various evidence-related issues, the book also sheds light on overarching questions including the role of IIA as a subsystem of international economic law.
