Afin de traiter la manière dont elle met en oeuvre les résolutions du Conseil de sécurité des Nations Unies, il convient de s'intéresser au rapport que le droit international entretient avec le droit communautaire. L'analyse porte notamment sur la personnalité juridique internationale de l'Union européenne, l'engagement de sa responsabilité internationale et sur l'implication de la structure en piliers de l'Union européenne. A travers les particularités du pilier PESC et du pilier relatif à la coopération policière et judiciaire en matière pénale (CPJP), il convient d'identifier les apports des différents traités jusqu'à l'adoption du traité de Lisbonne. Les conséquences liées à une articulation sur trois niveaux de la relation UE/ONU sont également mises en avant. Il s'agit ainsi d'évoquer les effets d'une mise en oeuvre s'opérant au niveau de l'ONU, où sont décidées les mesures à mettre en place, au niveau communautaire, où certaines initiatives sont entreprises dès l'origine de la construction européenne, et au niveau des Etats membres de l'Union, destinataires directs des décisions prises par le Conseil de sécurité. L'essor de la lutte contre le terrorisme et l'émergence de mesures relatives à la gestion des crises (dans ses composantes civile et militaire) permettent de délimiter les contours de la relation entre l'Union européenne et l'organisation internationale, dont l'étude nécessite une mise en perspective sous le prisme des droits fondamentaux, au regard de la jurisprudence de la CJUE et de la CEDH notamment.

Volume 1 begins with thorough descriptions of 20 different national legal systems of investigation and prosecution, addressing a range of evidential and procedural safeguards. These will serve as a point of reference for all future research on public prosecutors. Volume 1 also contains a series of cross-cutting studies of the key issues that will inform debates about the creation of a European Public Prosecutor's Office, including studies of vertical cooperation in administrative investigations in subsidy and competition cases, the accession of the EU to the ECHR, judicial control in cooperation in criminal matters, mutual recognition and decentralised enforcement of European competition law. Volume 2 (which will be published in 2013) presents a draft set of model rules for the procedure of the European Public Prosecutor's Office and continues with a set of comparative studies of the national legal systems that cover the gathering of evidence, seizure of assets, arrests, tracking and tracing, prosecution measures, procedural safeguards, the presumption of innocence and the right to silence, access to the file and victim reconciliation. Researchers at the Institute for Peace Research and Security Policy at the University of Hamburg investigated the consequences of this change for security governance in a multi-annual research program. Case studies show that transnational security policies changed, but that national governments remained dominant. In other words, the transnationalisation of threat perceptions only led to a limited internationalisaton of security policies. The volume presents results of the research program. It combines conceptual work on security governance with empirical research, for instance on counterterrorism, changing perceptions of security in international organizations, such as the European Union and the Organization for Security and Co-operation in Europe.

La personne morale apparaît comme le terme réunificateur de tout système representative. Dans l'ordre international, ce processus est perturbé par la présence, dans les organs intergouvernementaux, de représentants d'Etat qui sont autant d'organes des Etats membres, présence prolongée par le consentement aux actes adoptés en leur sein. Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.
