El autor trata de dar respuesta a estas preguntas a partir de la necesidad humana del amor y de la débil capacidad humana para amar, para concluir que el derecho opera donde tiene sentido que lo haga, es decir, allí donde las relaciones de justicia pueden vulnerarse. Esta escasa capacidad del ser humano para el amor adecuado tiene su paradigma histórico en la revolución sexual de la segunda mitad del siglo XX. Descubierta la posibilidad de vivir la sexualidad de un modo insospechado hasta entonces, se acusó al matrimonio de ser una institución que no sirve para organizar el amor. Desde entonces la institución matrimonial ha sufrido una profunda revisión con el propósito de ofrecer a las sociedades modernas algo mejor que una unión basada en una deuda de amor. El transcurso de dos generaciones desde aquella revolución sexual ha bastado para poner de relieve que el ensayo de lo que se llamó amor libre es un verdadero fracaso social. Si un mayor número de opciones sexuales no se traduce en un mayor índice de felicidad humana, significa que algo hay en el amor humano que reclama otra forma de entenderlo y otra forma de vivirlo. No es posible comprender el matrimonio si antes no se descubre la verdad sobre el amor en el que se basa. Ni basta cualquier sentimiento para amarse ni es suficiente cualquier relación para unirse. Entre personas capaces y libres, el modelo de unión natural viene determinado por el modelo apropiado de amor natural: aquel que responde a lo que es la persona, el amor auténtico. Comprender, vivir y proclamar la verdad del amor auténtico fue el deseo frustrado de la revolución sexual y es hoy uno de los más importantes retos culturales del siglo XXI.
