Book excerpt: This book addresses the different forms of austerity, contestation and resistance, in order to understand how they relate to one another and the impact they have on the democratic quality of public debates, the trust in public institutions and the legitimacy of law. Contestation of austerity includes not only traditional activism strategies such as human rights litigation and direct democracy instruments, but also new forms of collective action and collaborative resistance. Most importantly, many of the new anti-austerity initiatives also aim to renovate existing modes of democratic decision-making on the European, national, regional and local levels. The book focuses on different types of contesting austerity measures and the interaction between institutional and civil society actors. It will enhance understanding of how the various actors frame not only their goal but also the underlying social conflict to contest austerity and through which means they try to achieve political and legal changes. With 16 chapters written by contributors from Spain, Germany, Greece, Portugal and the UK, the book approaches 3 crucial areas of austerity policies: cuts in payment and pensions, labour law reform, and old and new poverty. In each field, the contributors analyse the processes of decision-making and contestation from 3 perspectives: institutions, democratic theory and societal responses.

Una de las cuestiones a tratar es si con los valores y principios vigentes es posible otro tipo de urbanismo que permita una mayor eficacia del artículo 47 de la Constitución Española.

Book excerpt: Esta tesis tiene como centro de investigación la efectividad/eficacia del derecho a la vivienda social digna incluido en el artículo 6o de la Constitución Federal de 1988. En este sentido, los principios de la dignidad humana y de la eficiencia pública, también previstos en la Constitución Federal, sirven como punto de referencia para la investigación y, al mismo tiempo, apuestan a que una lectura sistémica de los derechos sociales fundamentales constitucionales elaborados a partir de estos dos principios puede señalar nuevas direcciones de efectividad. En este contexto, pensar en la eficiencia de la acción pública nos da la oportunidad de distanciarnos de un enfoque económico ampliamente explotado en otras investigaciones. El sesgo económico, a nuestro juicio, puede eclipsar la obligación del Estado de promover y proteger los derechos sociales fundamentales. Por esta razón pensar en la vivienda como un lugar para vivir, como disfrute, señala otra faceta de la baja efectividad de este derecho centrado en el principio de la eficiencia pública. En este contexto, la experiencia brasileña cuenta con la participación de la sociedad en la construcción, promoción y protección de los derechos fundamentales y, por lo tanto, a nuestro juicio, le ofrece a la democracia participativa la base de un proceso que consolida la identidad constitucional, el Estado Democrático de Derecho. La tesis señala como sugerencia la necesidad de crear un consejo de la ciudad con la participación del Estado en los ámbitos ejecutivo, judicial y legislativo, con el sector privado y con la sociedad como una especie de responsabilidad compartida en la ejecución de las políticas públicas de regularización territorial urbana y, por último, en el ámbito judicial sugiere la creación de una jurisdicción especializada en urbanismo que pueda atender las demandas en términos del orden urbanístico elaborado en 2001 por el “Estatuto da Cidade”.

Book excerpt: Benito Pérez Galdós, considered Spain’s most important novelist after Cervantes, wrote 77 novels, several works of theater and a number of other tomes during his lifetime (1843–1920). His works have been translated into all major languages of the world, and many of his most highly regarded novels, those of the contemporary period, have been translated into English two, three and even four times over. Of the few “contemporary novels” of Galdós that until now have not come to light in English, The Forbidden is certainly among the most noteworthy. The story line concerns a wealthy philanderer, José María Bueno de Guzmán, who attempts to buy the favors of his three beautiful married cousins. He is successful with the first, Eloísa, a grasping materialist who falls deeply in love with him. Then he rejects her in order to attempt to seduce the youngest, Camila. Meanwhile, the third, the pseudo-intellectual María Juana, jealous, seduces José María. But it is Camila, healthy, impetuous and wild, who resists his temptations and holds our attention. The novelist and critic Leopoldo Alas, Galdós’s contemporary, calls her “the most feminine, graceful, lively female character that any modern novelist has painted.” As a naturalistic study, in the manner of Balzac in particular, principal characters of Galdós’s other novels (El doctor Centeno, La de Bringas, La familia de León Roch) become fleetingly visible in The Forbidden. In addition, the entire Bueno de Guzmán family gives evidence of the naturalistic emphasis on heredity: they all display certain physical or mental disorders. Eloísa has a morbid fear of feathers, María Juana often feels that she has a tiny piece of cloth caught in her teeth, José María suffers bouts of depression, an uncle is a kleptomaniac, one of the relatives writes letters to himself, etc. At the same time, this novel shows the foibles of Spanish society where status is determined by one’s associates, by the wearing of finery, and by living on borrowed money. In their history of Spanish literature, Chandler and Schwartz call Galdós “the greatest novelist of the nineteenth century and the only one who deserves to be mentioned in the same breath with great novelists like Balzac, Dickens and Dostoievsky.” The Forbidden, written at the height of the author’s creative powers, is a major work and its publication for an English-speaking audience is long overdue.
