La "funzione" dell'apparato penale, nel post-moderno, prende a consistere della conservazione del "sistema sociale", non mira più alla conservazione della società nei soli limiti necessari al pieno esplicarsi dell'autonomia individuale. Ora, invece, per dirla una volta di più con Rousseau, "il Sovrano non può imporre catene inutili alla comunità", formula questa che materializza un'idea dalla potente "forza critica": quella filosofia sociale delle libertà che "l'Illuminiso penale pre-rivoluzionario ha consegnato alla posterità attraverso la funzione critica della legalità penale". Il diritto penale deve costituire la "negazione di ogni forza", il essere il garante contro l'uso arbitrario della coercizione laddove la forza del diritto penale viene messa al servizio di un "fine particolare di governo".
