Book excerpt: La relation juridique fondamentale qu'entretiennent les avantages matrimoniaux et les donations entre époux est souvent résumée à l'aune de l'article 1527 du Code civil selon lequel les avantages matrimoniaux ne sont pas considérés comme des donations. L'ambition est de comprendre la nature et le fonctionnement de cette distinction fondamentale. Cette entreprise nécessite dans un premier temps d'éprouver la réalité de la disqualification légale selon laquelle les avantages matrimoniaux sont exclus des donations entre époux. L'étude du domaine et des critères de la distinction du titre gratuit et du titre onéreux démontre que l'avantage matrimonial est apte à s'inscrire dans une dimension gratuite. L'analyse des données catégoriques de l'acte libéral met en exergue l'aptitude de l'avantage matrimonial à consister en un déséquilibre économique consenti dans une intention libérale. Dès lors, la distinction ne peut qu'être fictive : l'existence d'une fiction disqualificative est ainsi révélée. Dans un second temps, la fiction disqualificative permet à l'avantage matrimonial de se présenter comme une voie concurrente à la libéralité pour la gratification du conjoint. Son efficacité doit être préservée, car elle procède d'une volonté législative qui remonte au Code Napoléon. Le domaine de la fiction doit donc être compris, ce qui nécessite une définition de la notion d'avantage matrimonial, désormais perçue comme utilitaire. Les effets de la fiction disqualificative doivent ensuite être organisés, car si l'objectif est la soustraction des dispositions du régime matrimonial aux règles contraignantes des libéralités conjugales, des tempéraments sont rendus nécessaires par la préservation de l'ordre public et des bonnes moeurs, dont le respect de la réserve héréditaire et la sanction de l'indignité successorale. La nature fictive de la distinction des avantages matrimoniaux et des donations entre époux révèle une utilité indéniable ; elle ne doit pas être anéantie mais renforcée, conformément aux voeux du législateur et aux intérêts des époux.
