Este ensayo trata de mostrar la operatividad de aquellos viejos condicionantes y sus pervivencias en la teoría actual. Cuestiona especialmente si es lícito seguir dependientes de las consecuencias empiristas una vez que el empirismo ha sido superado, y propone volver al estudio de los razonamientos jurídicos sin aquellas anteojeras que hoy ya carecen de sentido.
