Esto hace que cualquier “idea moral”, que haya podido estar en la base de los Derechos Humanos se desvanezca causando que, en lo sucesivo, estos Derechos evolucionen como productos ciegos de una dinámica social impuesta por los militantes de un pensamiento posmoderno y nihilista, que se instala progresivamente en la cultura. A la circunstancia anterior contribuye: i) El carácter mixto de un tribunal internacional, integrado con juristas de diferentes tradiciones jurídicas (Common Law y Civil Law), con un posicionamiento distinto frente a la norma jurídica escrita; ii) El impacto de las corrientes del sociologismo jurídico, que impelen a los jueces a saltarse las fronteras amuralladas de la norma escrita para encontrar el “derecho ideal” en la sociedad, convirtiéndose en sociólogos, intérpretes de las sensibilidades culturales y expectativas sociales; iii) El posicionamiento de estos servidores públicos internacionales frente a la concepción de la persona y su dignidad inherente, así como su posicionamiento frente a los fines del Derecho; en este último caso, teniendo presente los influjos de la filosofía de la “posmodernidad” y del “globalismo” y sus tendencias fuertemente “ideologizantes”.
