Book excerpt: Questo e-book tratta la disciplina del procedimento di mediazione per la conciliazione delle controversie civili e commerciali aventi per oggetto diritti disponibili introdotta dal decreto legislativo n. 28 del 2010, le cui norme di attuazione sono state dettate dal decreto del Ministro della giustizia n. 180 del 2010 (alcune di esse sono state modificate dai decreti del Ministero della giustizia n. 145 del 2011 e n. 139 del 2014), dopo la reintroduzione, da parte del decreto-legge n. 69 del 2013, convertito in legge n. 98 del 2013, della mediazione obbligatoria che la sentenza n. 272 del 2012 della Corte costituzionale aveva abrogato per eccesso di delega. Esso non si limita, però, alla sola esposizione dei contenuti delle norme di questi due testi normativi, il primo di natura legislativa e il secondo regolamentare, ma cerca di analizzare il più possibile i problemi interpretativi e pratici che esse pongono e le possibili soluzioni di questi. Grosso modo, possiamo dire che i primi sei paragrafi del testo sono dedicati all’esposizione dei contenuti del d.lgs. n. 28/2010, quindi all’analisi del procedimento di mediazione, mentre i paragrafi da 7 a 11 trattano maggiormente le disposizioni del d.m. 180/2010, quindi la disciplina delle spese della mediazione, quella degli organismi di mediazione e quella degli enti di formazione per i mediatori. Inoltre, nei capitoli 12, 13, 14, 15 e 16 sono contenuti degli approfondimenti su quattro problematiche che questa disciplina pone: quella della responsabilità civile per il fatto illecito commesso dal mediatore o dall’organismo di mediazione a danno di una o di entrambe le parti nel corso procedimento finalizzato alla conciliazione di una controversia; quella degli effetti che essa ha sulle procedure conciliative per le controversie in materia bancaria e finanziaria gestite da organismi creati dal sistema bancario prima dell’emanazione del d.lgs. n. 28/2010; quella del suo impatto sul tentativo obbligatorio di conciliazione previsto dall’art. 10 della legge n. 192 del 1998 per le controversie derivanti dai contratti di subfornitura; quella sulla mediazione per le controversie sui contratti di multiproprietà e su quelli relativi ai prodotti per le vacanze di lungo termine definiti dall’articolo 69 del Codice del consumo riformato dall’art. 2 del d.lgs. n. 79/2011.

But while we have lost our faith in utopias of all hues, the human aspiration that made this vision so compelling has not died. Instead it is re-emerging today as a vision focused not on the future but on the past, not on a future-to-be-created but on an abandoned and undead past that we could call retrotopia. The emergence of retrotopia is interwoven with the deepening gulf between power and politics that is a defining feature of our contemporary liquid-modern world—the gulf between the ability to get things done and the capability of deciding what things need to be done, a capability once vested with the territorially sovereign state. This deepening gulf has rendered nation-states unable to deliver on their promises, giving rise to a widespread disenchantment with the idea that the future will improve the human condition and a mistrust in the ability of nation-states to make this happen. True to the utopian spirit, retrotopia derives its stimulus from the urge to rectify the failings of the present human condition—though now by resurrecting the failed and forgotten potentials of the past. Imagined aspects of the past, genuine or putative, serve as the main landmarks today in drawing the road-map to a better world. Having lost all faith in the idea of building an alternative society of the future, many turn instead to the grand ideas of the past, buried but not yet dead. Such is retrotopia, the contours of which are examined by Zygmunt Bauman in this sharp dissection of our contemporary romance with the past.

This report investigates policy issues and discusses actions to retain and incentivise the elderly to work more by further reforming retirement policies and seniority-wages, investing in skills to improve productivity and keeping up with labour market changes through training policy, and ensuring good working conditions for better health with tackling long-hours working culture.
