La distribución de responsabilidades y funciones entre el Estado y la sociedad en la satisfacción de las necesidades reales de las personas y de los colectivos más vulnerables es un tema que tiene profundas raíces históricas y filosóficas, que entronca con la dignidad de la persona y que atañe al papel de la familia y de la mujer, como tradicional proveedora de cuidados, en la sociedad. Este libro tiene por objeto analizar los instrumentos jurídicos de colaboración público-privada que se han articulado, o que pueden articularse en un futuro, para cubrir las prestaciones y servicios a las personas desfavorecidas de las que se han responsabilizado los poderes públicos. Entre dichos instrumentos jurídicos se constata que el contrato, a pesar de ser el negocio jurídico aparentemente más adecuado para articular dicha colaboración, se ha tornado enormemente problemático y está siendo desplazado progresivamente por otras modalidades de colaboración, de dudosa naturaleza jurídica, como el convenio y el concierto social. Junto al análisis de los puntos débiles y los puntos fuertes de estas modalidades de colaboración público-privada, esta obra ofrece un esbozo de diversas fórmulas jurídicas alternativas, que pueden resultar de enorme utilidad para los operadores jurídicos. En concreto, entre otros, se analizan las posibilidades de implantación de sistemas organizativos basados en la elección de los prestadores de servicio por parte de los usuarios o en la imposición de obligaciones tuitivas entre sujetos privados, como manifestación de la externalización del Estado social.
