Mit ihrer Fähigkeit, komplexe Aufgaben eigenständig zu lösen und mitunter sogar Entscheidungen zu treffen, die bisher dem menschlichen Vorbehalt unterlagen, eröffnet KI nicht nur neue Möglichkeiten, sondern wirft auch eine Vielzahl rechtlicher Fragen auf. Der vorliegenden Arbeit liegt die Zielsetzung zugrunde, einen umfassenden Einblick in die rechtlichen Aspekte des Einsatzes Künstlicher Intelligenz zu geben. Hierbei sollen insbesondere die zivilrechtlichen Herausforderungen beleuchtet werden, denen sich Gesetzgebung und Rechtsprechung gegenübersehen. Denn gerade im Bereich des Zivilrechts werden grundlegende Fragen aufgeworfen, die den Umgang mit autonom agierenden Systemen betreffen, angefangen von der Abgabe von Willenserklärungen bis hin zur Frage der Haftung im Falle von Schäden. Die vorliegende Arbeit gliedert sich in mehrere Abschnitte. Zunächst erfolgt eine Klärung grundlegender Begriffe und Konzepte im Zusammenhang mit KI. Darauf aufbauend werden die zivilrechtlichen Herausforderungen, die sich aus dem Einsatz von KI ergeben, eingehend analysiert. Besonderes Augenmerk liegt hierbei auf Fragen der Rechtsfähigkeit und Haftung von autonomen Agenten sowie auf der Suche nach Lösungsansätzen für bestehende Rechtslücken. Ein besonderes Augenmerk wird auch auf die Diskussion um den Rechtsstatus einer elektronischen Person (ePerson) gelegt, wie sie von einigen Experten und sogar vom Europäischen Parlament angeregt wurde. Die Überlegung, autonome Agenten als eigenständige Rechtssubjekte anzuerkennen, wirft grundlegende Fragen auf und könnte potenziell wegweisende Konsequenzen für die Zukunft des Rechtsystems haben. Insgesamt soll diese Arbeit dazu beitragen, ein besseres Verständnis für die rechtlichen Implikationen des Einsatzes Künstlicher Intelligenz zu schaffen und mögliche Lösungswege für aktuelle Herausforderungen aufzuzeigen. Es bleibt jedoch festzuhalten, dass die Diskussion um den Umgang mit KI und autonomen Systemen erst am Anfang steht und weitere interdisziplinäre Forschung und rechtliche Entwicklung erforderlich sind, um diesem rasanten technologischen Wandel angemessen gerecht zu werden.

To have both of these convictions justifies to neglect dis ciplinary boundaries and poses a problem for the orthodoxies of either sides. All the essays of this volume focus on the relation between economic rationality and practical reason and discuss different aspects of the same problem, i. e. a basic deficiency in the standard economic theory of practical rationality. But philosophical analysis would not be of much help if it just rejected the economic paradigm. It must rather help to integrate economic aspects into a broader view on practical reason.
