Available in PDF, EPUB and Kindle. Book excerpt: This work identifies the continuing structural weaknesses of the Korean banking system, which were thrown into sharp relief by the 1997 financial crisis, and focuses on the need for reform in order to achieve financial stability. The study centres around three central questions: Who should be the regulator? What substantive standards of supervision should be applied? Administratively, in what manner should these standards be applied? The book argues that the Korean banking system, characterised as a `governmental control system' for credit allocation, should be removed from undue governmental and political interference, thus allowing the involvement of banks in commercially oriented practices without exposure to the significant risks incurred by governmental policy directed lending. The author calls for a high degree of transparency and accountability, for a clear, realistic timetable for restructuring, and for an effective exit policy for troubled commercial banks. This book will be of value to practitioners, researchers and academics working in the field of banking law, particularly those with a special interest in the Asia-Pacific region.

Book excerpt: After years of strong performance, Korea’s economy entered a crisis in 1997, owing largely to structural problems in its financial and corporate sectors. These problems emerged in the second half of that year, when the capital inflows that had helped finance Korea’s growth were reversed, as foreign investors—reeling from losses in other Southeast Asian economies—decided to reduce their exposure to Korea. This paper focuses on the sources of the crisis that originated in the financial sector, the measures taken to deal with it, and the evolution of key banking and financial variables in its aftermath.

Book excerpt: Ever since Korea succumbed to the East Asian economic crisis in 1997, its financial sector has been restructuring itself in accordance with the terms of an IMF bail-out package, in addition to meeting urgent domestic banking needs. All this is taking place in the context of an international convergence of supervisory standards in the banking industry, spearheaded by the General Agreement on Trade in Services (GATS) and the "Core Principles" of the Basel Committee for Bank Supervision. This nexus of events makes the current reform of Korean banking laws of special significance as an example and a test of the "new international financial architecture" as it can be observed at work in a developing industrial economy. This book is the first in-depth analysis of Korea's banking law reform program, its complex sources, its particular rules, the effect of international commitments as well as "soft law", the extent of economic recovery to date, and the trends and developments in banking practice and regulation likely to occur in the near future. In the process the author examines such pervasive issues as the following: the need for both short-term and long-term banking sector infrastructures and the tension this creates the clear necessity to satisfy deep-seated societal predispositions the role of foreign banks ensuring the transparency of bank management the role of banking regulatory institutions and the importance of domestic financial stability in the global free market system By revealing the implications for Korea of the international banking and financial standards and principles that are coming into effect throughout the trading world, Korea's Banking Law Reform lays bare the underpinnings of a domestic financial system geared to work efficiently in international financial markets, yet designed to protect its own "safety and soundness." This is a book to be read and studied by all professionals working in the financial sector, whether bankers, regulators, advisors, or investors.

Water is a vital element for agricultural production and for economic development in general. However, the spatial and temporal distribution of water in Mexico restrains its use. Because of this distribution, it has been necessary to build a large infrastructure to capture, store, and allot this element among water users. Around the world, countries that once promoted more government involvement in irrigation management are adopting new policies that do just the opposite, creating incentives for farmers to take over the management of operations and maintenance, while government agencies focus on improving the management of water at the main system level. Is this just another management fad; or will the pendulum that is now swinging toward greater management control by farmers soon swing back the other way, toward greater state control? This volume reports on four countries where the state's role in irrigation management has undergone fundamental change and where the result has been a much greater management role for farmers. These studies address the political antecedents of participatory irrigation management (PIM) policies, the process of implementing the policies, and the second-generation challenges of sustaining PIM. These experiences will prove useful to policymakers and irrigation professionals who are facing similar challenges in their own countries.

Korea has achieved a high degree of observance of key standards and codes through newly revised laws and competent supervision. However, supervisory independence could be strengthened to improve the ability to provide authoritative guidance and interpretation. Reform of the banking sector has restored profitability and improved its strength and resilience.

Book excerpt: Asian business conglomerates have clearly been successful agents of growth, mobilizing capital, borrowing technology from abroad and spearheading Asia's exports. However, these firms have long had a number of organisational and financial weaknesses, including heavy reliance on debt, that make them vulnerable to shocks. Nowhere was this more true than in Korea, where the large corporate groups known as chaebol have dominated the economic landscape. This collection of essays by leading political scientists and economists provides a comprehensive look at the chaebol problem in the wake of the Asian financial crisis. The authors consider the historical evolution of the chaebol and their contribution to the onset of economic turmoil in 1997. The book analyses the government's short-run response to corporate and financial distress, and outlines an agenda for longer-term reform of the financial system, corporate governance and the politics of business-government relations.

Examines the anatomy of the Republic of Korea's financial reform policy since 1979 in order to place the nation's financial reform plan of 1993 in a proper context. Financial deregulation in the Republic of Korea, initiated in 1979, coincided with similar programs in South America and East Asia. The reforms were successful in spite of a mild form of financial repression and a deregulation policy that ran an erratic course. The republic moved decisively in 1993 toward a conventional type of financial liberalization by announcing a blueprint of reforms to be implemented over a five-year period ending in 1997. This paper examines the anatomy of the Korean financial reform policy since 1979 in order to place its financial reform plan of 1993 in the proper context. The report presents a conceptual framework of the Korean financial system and policies, examines interest rate reforms on various levels, and discusses changes in the credit allocation system that were undertaken in earlier phases of the reforms. The book goes on to review the rationale of the final financial reform phase, the sequencing of its various elements, and the assessment. Broad conclusions are presented.

Book excerpt: SUMMARY, KEY FINDINGS, AND RECOMMENDATIONS The Republic of Korea has a moderate level of compliance with the Basel Core Principles for Effective Banking Supervision (BCP). Building upon the 2003 FSAP recommendations, the authorities have taken resolute steps to strengthen the regulation and supervision of the banking sector. However, the assessment identified gaps that need to be addressed and although the Republic of Korea counts with a strong—albeit overly complex—regulatory framework and with thorough supervisory practices, a number of areas require attention so that the Republic of Korea can meet the highest standards of supervisory effectiveness. Those areas include: broader powers to apply minimum capital requirements to individual banks; full implementation of Pillar 2 and ICAAP; and a more comprehensive approach to conglomerates. The application of Basel II to Financial Holding Companies (FHCs) would complement the transition to group supervision which began through the introduction of the FHC Act. Despite the deficiencies identified in the assessment, the current supervisory structure has been reasonably effective and the overall vulnerability of the Korean banking system has diminished since the 2008 crisis with stronger capitalization across the sector. Supervision of the banks is structured around sound off-site supervision techniques and onsite inspections. Strengths lie in sophisticated offsite monitoring capabilities and an extensive onsite capability. The FSC-FSS collects and analyzes a broad suite of information including detailed financial and management information. The supervisory approach relies heavily on off-site monitoring and notifications of exceptions, which are supplemented by biannual full-scope on-site examinations. The existence of multiple points of responsibility, where subject matter experts are responsible for different areas of surveillance poses challenges of coordination and to derive an overall understanding risk to an institution. The Republic of Korea is one of the first countries to be assessed under the revised Basel Core Principles (BCP) issued by the Basel Committee in September 2012. Like other countries being assessed under the new methodology, the Republic of Korea has agreed to be assessed and rated not only on the essential criteria but also on the additional criteria. It is important to note that since last assessment, conducted in 2003, the bar of the standards has been raised twice by the BCBS (the BCP methodology was revised in 2006 and again in 2012). This assessment, consequently, is not comparable with the previous assessment and, as prescribed by its methodology, should not be compared or across countries. Within the revised BCP methodology, more is expected of supervision and regulation, and much of what was considered “desirable” is now considered essential, with the lessons of crisis and evolution of financial markets and international standards. The assessment also brings a new relevance to observed implementation and practices.

Book excerpt: Masterarbeit aus dem Jahr 2007 im Fachbereich VWL - Konjunktur und Wachstum, Sprache: Deutsch, Abstract: Basically, the Korea's financial sector has gone through three development period under two different types of financial systems. During these three periods, in theory, two financial systems were applied into the Korea's financial sector: the relationship-based (or state-led) system (from 1960s to late 1980s) and the market-based system (after late 1980s till now). But in fact, due to the differences in applying the market style into Korea, we can see in the second system's time, there was obviously two periods, the period of 'gradualism' and the period of 'Big Bang' with the turning point is in 1997. Therefore, it is better to define the history of Korea's financial development into three periods. The first period started from early 1960s (after the military coup which brought Park Chung Hee to the position of President) to the late 1980s, in which Korea's economy was under the relationship-based system; the second period lasted from late 1980s to 1997 when the financial crisis occurred due to wrong policies under 'gradualism' and bad effects of the first period; and the last period started from 1997 up to now when Korea take 'Big Bang' approach to cure its illness after the failure in 1997. Researching the evolution of Korea's financial system during the three periods as a whole process is important to collect experiences for under-developing country such as Vietnam to improve its financial system. Even though the conditions of Vietnam and Korea are different, but still, the logic behind each policy that the Korean government used in the past will be a big help to Vietnam as well as finding out the reasons of the failures that Korea did not avoid.

Book excerpt: Whatever can be said about the financial crises that have plagued East Asian countries since the early 1990s, it must be averred that they teach us a great deal. Many earlier assumptions about finance and investment have been called into question, and the field is more open than it has been in many decades to legal and economic analysis and theory. In particular, issues of financial sector reform have come into sharp focus. Here is a new proposal, solidly grounded in current reality, for a regional "zone of law" designed to supplement and benefit domestic reforms under way in Japan and the three emerging economies of Indonesia, South Korea, and Thailand. The author draws on a wide range of relevant material, including exploration of international standards and "best practices" in banking and finance, the experience of the U.S. and the U.K. in planning and implementing reform measures, and the theoretical literature respecting financial crises and what causes them. In this context, the specific reforms applied in the four Asian countries under consideration are discussed in detail, with "lessons to be learned" about crisis detection, containment, and prevention. During the course of the analysis, the author reveals fundamental policy areas where meaningful and effective reform can take place. Financial Stability Issues: The Case of East Asia offers numerous practical applications at the same time as it strikes a rich vein of theory in the field. Its fresh, sensible approach will be greatly appreciated, not only by academic theorists, but by hardheaded business people, policymakers, and regulators as well.

Book excerpt: Since the financial crisis in 1997-98, Korea has made major progress in financial, and corporate sector reform - the supervisory and regulatory regime for the financial sector has been substantially strengthened, and recent reforms helped achieve a high degree of observance of international standards, and codes. Moreover, significant consolidation in the banking system took place, with banks becoming more profit oriented, and their operations streamlined. The impressive macroeconomic performance led to strong real growth, low inflation, and growing official foreign reserves, facilitating the improvement of measured financial sector soundness. However, important reform measures were delayed, e.g., addressing issues in the areas of insurance and securities, adopting the insolvency framework, and in the completion of corporate restructuring, reforms crucial to prevent an economic downturn. Despite progress in prudential supervision, concerns remain on the regulator's ability to supervise risks, and, information and monitoring of connected lending and cross ownership in the financial crisis, also remain issues of concern. Key recommendations suggest that steps should be taken to reassure markets that the independence of the regulator is important; that measures to strengthen provisioning for household lending are welcome; that a full examination of the Korea Development Bank should be conducted, including a review of the derivatives-related accounting systems, complemented by a targeted external audit of the bank; a continued pension reform is urgent given the rapidly aging population; and, particularly worrisome is the seemingly inadequate supervision of the problems arising from non-bank deposits taking institutions' face soundness, where tighter supervision of securities is warranted. Similarly, corporate governance and disclosure need further steps, aligning accounting and auditing reforms with evolving internal best practices.

Book excerpt: A Brookings Institution Press and Asian Development Bank Institute Although emerging economies as a group performed well during the global recession, weathering the recession better than advanced economies, there were sharp differences among them and across regions. The emerging economies of Asia had the most favorable outcomes, surviving the ravages of the global financial crisis with relatively modest declines in growth rates in most cases. China and India maintained strong growth during the crisis and played an important role in facilitating global economic recovery. In this informative volume, the second in a series on emerging markets, editors Masahiro Kawai and Eswar Prasad and the contributors analyze the major domestic macroeconomic and financial policy issues that could limit the growth potential of Asian emerging markets, such as rising inflation and surging capital inflows, with the accompanying risks of asset and credit market bubbles and of rapid currency appreciation. The book examines strategies to promote financial stability, including reforms for financial market development and macroprudential supervision and regulation.

Book excerpt: 'Filled with fresh observations from the global financial crisis, this book provides a blueprint for making Asia's financial systems safe. With contributions from experts in several countries, it is both comprehensive and rigorous. It will be invaluable to policy makers and students of finance everywhere, but its unique Asian perspective provides special insight into the systems that managed to ride out the global crisis but absent further reform might set the stage for another one. The book's analysis and recommendations deserve urgent policy attention.' Peter Petri, Brandeis University, US 'What are the lessons of the global financial crisis of 20072009 for Asia? This is a key issue for Asia today. On one hand, some observers argue that following the Asian financial crisis in 199798, most Asian developing countries built up strong mechanisms to guarantee financial stability. But the recent financial shocks across America and Europe show that even the best financial systems have key weaknesses. This book is a valuable guide for Asian financial policy-makers of the road ahead.' Peter McCawley, Australian National University In light of the experience of the global financial crisis, this book develops concrete recommendations for financial sector reform and regulation in Asian economies aimed at preventing the recurrence of systemic financial crises, improving the ability to manage and resolve crises, managing capital flows, and promoting the development of Asian bond markets. The focus of the book is on longer-term structural measures. It explores areas such as the scope for regional monitoring and cooperation; deepening and integration of Asian bond and money markets; liberalization/regulation of capital flows; issues related to macroprudential oversight, regulatory structure and cooperation; as well as role of state intervention in crisis resolution in the financial sector. The need for and impacts of regulations on innovative financial products and specific investor groups such as hedge funds; ways to reduce systemic risk of pro-cyclicality of regulation; and ways to improve the infrastructure and regulatory environment for local currency bond markets, are also examined in depth. The book will appeal to public and private finance experts, policy and decisions makers in governments and banks, think-tanks, and students in graduate courses related to financial and economic development.
