Book excerpt: Justice After War is aimed especially to both undergraduate and graduate students, as well as the general audience who want to understand the significance of a recent development within the just war tradition, namely, the increasing attention given to the category of jus post bellum (postwar justice and peace). While examining the interrelated challenges of moral and social norms in both political and legal domains, as well as church practices, this work proposes an innovative methodology for linking theology, ethics, and social science so that the ideal and the real can inform each other in the ethics of war and peacebuilding. The main task of this project, then, is to identify what the author views as three key themes of jus post bellum, and three practices that are essential to implementing jus post bellum immediately after a war: just policing, just punishment, and just political participation. David Kwon endeavors to challenge the view of those who suggest that reconciliation, mainly political reconciliation, is the foremost ambition of jus post bellum. Instead, he attempts to justify the proposition that achieving just policing, just punishment, and just political participation are essential to building a just peace, a peace in which the fundamental characteristic must be human security. It thus demonstrates that human security is an oft-neglected theme in the recent discourse of moral theologians and that a more balanced understanding of jus post bellum will direct attention to the elements composing human security in a postwar context.

The underlying research question consequently asks: if the concept of the R2P addresses prevention, conflict management as well as post conflict rebuilding, does there exist an obligation and a legal 1 HIICR, Conflict Barometer 2010, http://hiik.de/de/konfliktbarometer/index.html. 4 justification within this context for a jus post bellum under the international law? Measures for an after conflict time rebuilding have never been before part of a wider legal concept to fight violent conflicts. It often was treated as part of development efforts and policies, but never as a legal obligation for an intervening party. For this reason some legal experts call it already a jus post bellum. The term of the jus post bellum then describes the legal responsibility and commitment of the international community as well as certain individual nations within the overall frame of the R2P. The hypothesis for that reason is that the concept of the Responsibility to Protect will fail to prevent deadly conflicts as long there is no legal obligation and an international tool set for a jus post bellum as a pre-conflict prevention of a new outbreak. Within the essay, the author wants to provide an overview of the Concept of the R2P, the legal perception of this concept in the context of the Law of Armed Conflict and especially of the obligations and possibilities coming along with this concept after the end of violent conducts. The research question therefore provides the framework for this essay, whilst the hypothesis shall be used to prove limitations and possibilities of a legal concept that might develop towards a jus post bellum.

His views have been categorized into the concepts of jus ad bellum, jus in bello, and, more recently, jus post bellum. Jus ad bellum and jus in bello address the moral responsibilities of a nation and its sovereign as the decision to enter into conflict is made and as agents of the state endeavor to keep human suffering to a minimum. Jus post bellum is a more recent ideal that has, since World War I, addressed the need to establish a long-lasting peace upon the conclusion of hostilities. Interestingly, while the proponents of jus post bellum appeal to the Augustinian ideal of promoting a lasting peace, this attribution has taken place relatively recently. Therefore, the purpose of this work is to examine whether or not Augustine would have agreed with the idea of jus post bellum as it is practiced today. Chapter one presents research questions, a literary review, and a methodology of study. Chapter two addresses what Augustine said about war in his own writings while providing necessary historical context. Chapter three examines the formulation and development of jus post bellum. In chapter four, practical examples of jus post bellum are discussed and traced back to their Augustinian origins. This work then concludes with apologetic implications before noting areas for further study. As a whole, this book finds that, while the principles of jus post bellum, as advocated for by Augustine, were fulfilled in the conflicts preceding the mid-twentieth century, recent experiences in Iraq and Afghanistan have shown a need to revisit Augustine's framework. Furthermore, with the recent conclusion of the American experience in Afghanistan, the time is ripe to examine the lessons learned and reintroduce a Christian worldview into future jus post bellum decision processes.
