En esta tercera edición permanece por su interés y profundidad -con las actualizaciones imprescindibles- el estudio que hizo el autor, Hermenegildo Baylos, acerca de la problemática de los derechos intelectuales, las teorías sobre su tratamiento, los precedentes históricos de protección, la naturaleza jurídica de estos derechos y la justificación que encontró el autor acerca del tratamiento unitario de la propiedad industrial y el derecho de autor, bajo la denominación de “Derecho Industrial”. Como referencia necesaria por el carácter excluyente de los derechos sobre bienes inmateriales, se aborda también el estudio de las nociones fundamentales del Derecho de la Competencia Económica, en sus dos vertientes de “anti trust” y competencia desleal. En la tercera edición se pone al día el derecho positivo español sobre la Defensa de la Competencia, la Competencia Desleal y la Publicidad con mención a Directivas y Reglamentos Comunitarios. La protección de los derechos de autor contiene una total actualización y exposición de las normas que los regulan, con un intenso y pormenorizado repaso del Texto Refundido de la Ley de Propiedad Intelectual, así como una exposición de los Tratados Internacionales que rigen en este sector. La regulación de las diferentes instituciones protegidas por la propiedad industrial está totalmente puesta al día, con el estudio de las últimas modificaciones de la Ley de Patentes y Modelos de Utilidad de 1986, la Ley de Marcas de 7 de diciembre de 2001 y la Ley de Protección Jurídica del Diseño Industrial, de 7 de julio de 2003, con un examen del diseño industrial nacional que carecía de regulación específica. Todo ello con las necesarias referencias a la Ley de 5 de junio de 2006 que, por imperativo comunitario, amplía los medios de tutela de los derechos de propiedad intelectual e industrial. Se incluyen las dos nuevas modalidades comunitarias: la marca comunitaria, creada por el Reglamento sobre Marca Comunitaria, de 20 de diciembre de 1993, y los dibujos y modelos comunitarios, regulados en el Reglamento sobre los Dibujos y Modelos Comunitarios de 12 de diciembre de 2001. Por su amplitud y aportación doctrinal es una obra de obligada lectura para todo estudioso de las creaciones intelectuales, cualquiera que sea su nacionalidad ya que proporciona un profundo examen de los conceptos y doctrinas sobre estas creaciones y, además, por la actualización que contiene del derecho positivo, es de gran utilidad para los Abogados especializados en propiedad industrial y derecho de autor y para los Agentes de la Propiedad Industrial.
