In addition, the use of customary law alongside national law is frequently portrayed as a vehicle of resistance. This book argues that, because ordinary Indians are not positively biased in favor of customary law per se, a heterogeneity of legal practices can be observed on a daily basis, which consequently undermines the commonly held view of customary law as a "counter-hegemonic strategy", even if, on other socio-geographical levels, this thinking in terms of resistance holds true. Based on qualitative research, the work analyzes how internal conflicts among indigenous inhabitants of the Ecuadorian highlands are being settled in a situation of formal legal pluralism, and what can be learned from this in terms of Indian-state relationships. It is shown that, on a local level, the phenomenological dimension of legal pluralism can be termed "interlegality." On a macro level, ontological assumptions underscore that legal pluralism is still seen as a dichotomy between customary and national law. Multidisciplinary in nature, the book will be of interest to academics and researchers working in the areas of Legal Pluralism, Cultural Anthropology and Latin American Studies.

More than a quarter of the Colombian national territory belongs to indigenous groups, and 80 percent of the country’s mineral resources are located in native-owned lands. In this innovative ethnography, Joanne Rappaport draws on research she has conducted in Colombia over the past decade—and particularly on her collaborations with activists—to explore the country’s multifaceted indigenous movement, which, after almost 35 years, continues to press for rights to live as indigenous people in a pluralistic society that recognizes them as citizens. Focusing on the intellectuals involved in the movement, Rappaport traces the development of a distinctly indigenous modernity in Latin America—one that defies common stereotypes of separatism or a romantic return to the past. As she reveals, this emerging form of modernity is characterized by interethnic communication and the reframing of selectively appropriated Western research methodologies within indigenous philosophical frameworks. Book excerpt: International norms widely recognize the Indigenous right to self-determination by which Indigenous peoples define and purse their collective aspirations. Nevertheless, as progressive as legal frameworks might appear, in reality, few Indigenous communities enjoy this right and most remain vulnerable and disempowered. Activists blame Latin America's extractivist economies, while governments argue that extractive revenues are necessary to improve Indigenous life. Far from presenting a unified position, rural Indigenous peoples are most often divided over extractive industries. To assess how Indigenous self-determination has progressed, and the role that extractivism plays in this, this Element examines six Indigenous communities in Mexico, Bolivia, and Peru with contrasting experiences of extractive projects. It finds that the Indigenous ability to use favorable legislation in conjunction with available economic resources shapes different self-determination outcomes. Finally, it assesses Indigenous possibilities for self-determination in the light of environmental activism and discourses on Buen Vivir.
