Available in PDF, EPUB and Kindle. Book excerpt: This is a completely revised and updated edition of a book which has become widely accepted internationally as a standard work on international humanitarian law. The book contains authoritative texts of the main treaties and other key documents covering a wide variety of issues: the rights and duties of both belligerents and neutrals; prohibitions or restrictions on the use of particular weapons; the protection of victims of war, including the wounded and sick, prisoners of war, andcivilians; the application of the law to forces operating under UN auspices; the attempts to apply the laws of war in civil wars; the prosecution of war crimes and genocide; the legality of the threat or use of nuclear weapons; and many other matters. This third edition, greatly expanded from the second, contains thirteen new documents, including agreements on anti-personnel mines and laser weapons; key extracts from the statutes of the international criminal tribunals for the former Yugoslavia and Rwanda, and the International Criminal Court; two documents on UN forces and international humanitarian law; and an extract from the Advisory Opinion of the International Court of Justice on nuclear weapons. There is a new appendix listing internet websites. All the editorial text is revised and updated. The Introduction sets the subject in its historical context, outlines the various sources of the law, provides basic information about its application to states and individuals, and discusses its relevance in contemporary conflicts. In addition, each of the documents is preceded by a prefatory note by the editors, explaining matters relating to its adoption, interpretation and implementation, including how it relates to other agreements concluded subsequently. Each treaty is followed by a complete list of all states parties, along with the dates of adherence and details of any reservations or declarations which states have made. Prepared with extensive assistance from the official Depositaries of the various agreements, this is an essential reference book for statesmen and diplomats, members of armed forces and humanitarian organizations, lawyers, journalists, and students of international law and international relations.

The Fourth Edition addresses a number of significant developments in the human rights arena including: Emergence of international criminal law as a potential response to crimes against humanity; Emergence of the United Nations Security Council as a significant human rights actor and the challenges it faces; The role of human rights norms in responding to and regulating state responses to terrorism; The capacity of human rights to respond to abuses by corporate actors; The ability of human rights to respond to and account for violations committed in the context of ethnic hatred, internal conflict, and intrastate violence; and The challenges faced by non-government human rights organizations in the post 9/11 context. International Human Rights is also accompanied by a comprehensive documentary supplement, Selected International Human Rights Instruments and Bibliography for Research on International Human Rights Law. Available in PDF, EPUB and Kindle. Book excerpt: The break-up of the Soviet Union, Yugoslavia and Czechoslovakia and the unification of Germany in the 1990s marked the dramatic return to center stage in international law of the issue of State succession. This book deals with one particularly controversial aspect of State succession that until now has not received much attention: the question of State succession to international responsibility. In State Succession to International Responsibility the international lawyer and scholar Patrick Dumberry addresses the question, critical for our times, whether or not a new State may be held responsible for wrongful acts committed before its independence by the predecessor State. He also considers the reverse situation: whether or not a new State may claim reparations for wrongful acts committed before its independence by third parties and which affected the predecessor State or one of its nationals. State Succession to International Responsibility contains the most comprehensive analysis ever published of doctrine and State practice related to these questions. It is the first attempt to examine systematically State conduct, both historical and modern, with a view to identifying the factors and circumstances under which rights and obligations of a predecessor State may be transferred to a new State. Available in PDF, EPUB and Kindle. Book excerpt: Mesopotamia is often considered to be the birthplace of law codes. In recognition of this fact and motivated by the perennial interest in the topic among Assyriologists, the 59th Rencontre Assyriologique Internationale was organized in Ghent in 2013 around the theme “Law and (Dis)Order in the Ancient Near East.” Based on papers delivered at that meeting, this volume contains twenty-six essays that focus on archaeological, philological, and historical topics related to order and chaos in the Ancient Near East. Written by a diverse array of international scholars, the contributions to this book explore laws and legal practices in the Ur III, Old Babylonian, Middle Assyrian, and Neo-Assyrian periods in Mesopotamia, as well as in Nuzi and the Hebrew Bible. Among the subjects covered are the Code of Hammurabi, legal phraseology, the archaeological traces of the organization of community life, and biblical law. The volume also contains essays that explore the concepts of chaos/disorder and law/order in divinatory texts and literature. Wide-ranging and cutting-edge, the essays in this collection will be of interest to Assyriologists, especially members of the International Association for Assyriology.

Book excerpt: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany. The research recognizes that despite seemingly very different legal traditions and structures, prosecutors in these systems are similar enough that each system might learn from the others. Drawing upon the experiences of other nations, this research proposes solutions to the problems identified in connection with the position and powers of public prosecutors in the United States. Furthermore, it outlines the problems related to the increase of prosecutorial power and the lessons the European criminal justice systems surveyed can draw from the experience in the US. In terms of methodology, this research not only considers formal legal provisions but also systematic structural factors, academic literature and statistics revealing how the law and governing principles actually work in practice.
