Book excerpt: Judicial independence is generally understood as requiring that judges must be insulated from political life. The central claim of this work is that far from standing apart from the political realm, judicial independence is a product of it. It is defined and protected through interactions between judges and politicians. In short, judicial independence is a political achievement. This is the main conclusion of a three-year research project on the major changes introduced by the Constitutional Reform Act 2005, and the consequences for judicial independence and accountability. The authors interviewed over 150 judges, politicians, civil servants and practitioners to understand the day-to-day processes of negotiation and interaction between politicians and judges. They conclude that the greatest threat to judicial independence in future may lie not from politicians actively seeking to undermine the courts, but rather from their increasing disengagement from the justice system and the judiciary.

Book excerpt: The Greek pension system has been costly, complex, and distortive, which has contributed to Greece’s fiscal problems and discouraged labor force participation. Several attempts to reform the system faltered due to lack of implementation, pushback by vested interests, and court rulings leading to reversals. A series of reforms introduced throughout 2015–17 unified benefit and contribution rules, removed several distortions and reduced fragmentation and costs. If fully implemented throughout the long-term, these reforms can go a long way towards enhancing the pension system affordability. However, reforms faced setbacks and fell short of creating stronger incentives to build long contribution histories, to deliver sustainable growth by improving the fiscal policy mix, and to ensure fairness and equitable burden sharing across generations and interest groups. Policy priorities should aim towards fully implementing the 2015–17 reforms and complementing them with additional reforms to address these remaining objectives.

This universal credit will radically simplify the system to make work pay and combat worklessness and poverty. The consultation document (Cm. 7913, ISBN 9780101791328) spelt out the issues and the consultation responses (Cm. 7971, ISBN 9780101797122), publishing simultaneously with this paper, broadly welcomed the proposals that were put forward. Universal credit is an integrated working-age credit that will provide a basic allowance with additional elements for children, disability, housing and caring. It will support people both in and out of work replacing working tax credit, child tax credit, housing benefit, income support, income-based jobseeker's allowance and income related employment and support allowance. The universal credit will improve financial work incentives by ensuring that support reduction is tapered at a consistent and managed rate. It will also be backed up by a strong system of conditionality. As a simpler system managed by one department it will reduce the scope for costly errors and fraud. The universal credit will not replace: contributory jobseeker's allowance & contributory employment and support allowance which will continue aligned to earnings; disability living allowance; child benefit; and bereavement benefits, statutory sick pay, statutory maternity pay, maternity allowance and industrial injuries disablement benefit

The New Regulatory Framework for Consumer Dispute Resolution examines the impact of the new EU law in the field of consumer redress. Part I of the volume examines the new European legal framework and the main methods of consumer redress, including mediation, arbitration, and ombudsman schemes. Part II analyses the implementation of the ADR Directive in nine Member States with very different legal cultures in consumer redress, namely: Belgium, Ireland, Italy, Germany, France, Portugal, Spain, the Netherlands and the UK, as well as the distinct approach taken in the US. Part III evaluates new trends in consumer ADR (CDR) by identifying best practices and looking at future trends in the field. In particular, it offers a vision of the future of CDR which is more than a mere dispute resolution tool, it poses a model on dispute system design for CDR, it examines the challenges of cross-border disputes, it proposes a strategy to promote mediation, and it identifies good practices of CDR and collective redress. It finds that while gaps in living standards have been closing in many countries, the well-being of households in the bottom 40 percent, as measured by the non-income MDGs such as access to education and health services, remains below that of households in the top 60 percent. The focus of this year's report is on three elements needed to make growth more inclusive and sustainable: investment in human capital that favors the poor, the best use of safety nets, and steps to ensure the environmental sustainability of economic growth. These three elements are imperative to all countries' development strategies, and are also fundamental to global efforts to achieve the twin goals, the MDGs, and the Sustainable Development Goals that will succeed the MDGs. Global Monitoring Report 2014/2015 was prepared in collaboration with regional development banks and other multilateral partners.

Book excerpt: In 2008, the Liaison Committee and the Government agreed a process for departmental select committees to undertake pre-appointment hearings in which they examine the suitability of the Government's preferred candidate for certain public posts. The purpose is to test the individual's independence and expertise, consider any potential conflicts of interest and explore how the individual intends to undertake the job, including his or her accountability to the Committee. Select committees do not have the power to veto appointments. However, the Minister is expected to consider relevant observations before proceeding with an appointment. The pre-appointment hearing for the posts of Pensions Ombudsman and Pension Protection Fund Ombudsman (held by the same individual) falls within the remit of the Work and Pensions Committee. On 15 October 2014 the Minister for Pensions informed us that Tony King, the current Pensions Ombudsman and Pension Protection Fund Ombudsman, would be stepping down in spring 2015.[4] He set out the recruitment exercise that would be followed to select the new Ombudsman and invited us to undertake pre-appointment scrutiny of the preferred candidate, in accordance with the agreed arrangements. The Department for Work and Pensions (DWP) launched the recruitment process on 29 November 2014. The Minister notified us of the name of the preferred candidate on 3 February 2015. In announcing the selection process, DWP also indicated that a recruitment exercise would be undertaken for the post of Deputy Pensions Ombudsman (and Deputy Pension Protection Fund Ombudsman). This is a part-time role and is not subject to a pre-appointment hearing.
