Download or read book Unrestrained written by Robert Nagel and published by Routledge. This book was released on 2017-07-28 with total page 213 pages. Available in PDF, EPUB and Kindle. Book excerpt: Robert Nagel's innovative volume attempts to explain why, despite almost four decades of conservative and moderate appointments, the Supreme Court continues to intervene aggressively in a wide array of social and political issues. The explanation lies primarily in the psychological effects of the way that lawyers think about law and judging. The instincts ingrained by the experiences common to legal education and the successful practice of law also work to encourage the reckless use of power.Nagel argues that the problem with the modern judicial role is cultural and political. He demonstrates that judges, especially Supreme Court justices, have degraded our political discourse, intensified social conflict, and drained moral confidence.By examining modern Supreme Court confirmation hearings along with certain classic legal writings, Nagel shows how modern lawyers have a broad consensus on how to interpret the Constitution and, more generally, how to think about law. One major component of this mindset is to combine realism with legalism in ways that naturally tend to expand the judiciary's imperial role. Realism counsels that decisions are inevitably partly personal and therefore cannot be conclusively justified while legalism imparts the sense that the judge's interpretation is the best one possible. This combination of the personal and political, along with other aspects of modem legal thinking and training, means that judges are not only unconstrained by professional norms but actually are impelled by them to use power expansively. This issue is important to every person living in the U.S., as the Supreme Court's decisions concern everyone in the nation. It has the potential to be read by lawmakers, lawyers, students of law and political science, and anyone interested in Constitutional law. The thesis is unique and the execution is precise.
Book Synopsis A Judge's Advice by : Ruggero J. Aldisert
Download or read book A Judge's Advice written by Ruggero J. Aldisert and published by . This book was released on 2011 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book has one objective in mind: to enrich the skills of lawyers and law students so that each may bear--to borrow from Izaak Walton's The Compleat Angler--the noble title of "compleat lawyer." The voice belongs to a nonagenarian who has rolled up his sleeves, sat back in his chair and said he is willing to share observations on the law--both its anatomy and philosophical purposes--based on his rather prodigious and extensive experience. The content includes selective reflections from Judge Aldisert's books, lectures and essays over 14 years as a lawyer and 50 years as a judge, teacher and author. Five major law themes have commanded his special interest over the years: the common law tradition, logic and law, the institutional crisis facing appellate courts, quality writing, and the judicial process. Lawyers and law students will be afforded answers to these queries: What is the bedrock of our common law system and how can I use that knowledge to better advocate? What are trial and appellate judges really looking for? How can I create a writing structure that will persuade? What is the logical configuration that is absolutely necessary in any legal argument? What practical challenges do judges face when deciding my case? Howdo I convince a judge to decide my way when no precedent controls and the law is not clear? For a lawyer in the courtroom to become a truly compleat lawyer, he or she must learn "Why am I doing what I do?" And that's what this book is all about. "[N]o other single volume that I am aware of so neatly and clearly explains the American legal system. This book explains stare decisis better than anything else available. Judge Aldisert writes about his particular passion -- the law -- with an enthusiasm that is almost exhausting. Through this book the law student can get a glimpse of just how enormously satisfying the next 60 or 70 years of his or her life can be....This book really should be required reading for all law students, lawyers and others too." -- Paul Lomio, library director and law lecturer at Stanford Law School
Book Synopsis Lawyers, Judges and Journalists by : Robert B. Surrick
Download or read book Lawyers, Judges and Journalists written by Robert B. Surrick and published by . This book was released on 2003-07 with total page 356 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Messiah and Me is the story of a Jewish girl who accepted Jesus as her Lord and Savior despite a longstanding aversion to anything even remotely associated with Christianity. The story begins in New Jersey and describes how the author's early exposure to Catholicism informed her thinking and understanding of Christianity throughout her childhood and adolescence. The narrative takes the reader on a spiritual journey across the country and through many of the experiences that characterized the 1960s. As the author describes her search for understanding, she deconstructs many of the misconceptions about Jesus and re-presents him as the Jewish Messiah. The Messiah and Me offers a conservative, yet contemporary, view of Christianity, contrasting it with post-modern views on religion and morality. This is a book that can correct misconceptions, break down barriers, and open the door for both Jews and Gentiles to embark upon a personal relationship with the Messiah.
Download or read book Making Law written by Richard C. Cahn and published by Gatekeeper Press. This book was released on 2020-04-14 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: This unique memoir tells firsthand the stories of six dramatic public court cases, and shows how lawyers, sometimes fighting to make new precedent, and impartial judges who hear their arguments, are our best protection against inappropriate governmental actions. These are adventure stories, involving ordinary people attempting to protect themselves from actions by strangers or a public official that threaten to upend their lives: A male cadet soon to be commissioned learns that newly-coed West Point intends to expel him for “walking with” a female cadet. The family of the victims of three horrifying murders committed on an American military base seek justice after the government states it will not prosecute the probable murderer. Parents of a newborn baby with life-threatening medical conditions are sued by political zealots for custody of their child and the right to make her medical decisions. Other adventures involve the author, then 34, going to Washington to ask a sharply divided Supreme Court to invalidate his county’s 300-year -old charter in the first local reapportionment case in the nation; an emotional court confrontation between the White and Black populations of a local suburban community over zoning policies that it and most other American suburbs followed for many years; and New York’s high court missing an opportunity to prevent the 2007-2008 world financial crisis. These cases affected the lives of many, and became part of a long tradition of Constitutional law gradually changing to meet new conditions. The book is a clarion call to restore the courts’ impartility.
