Book excerpt: A critical overview of European Union energy law and policy, this book takes a law-in-context approach as it examines the development of EU energy law from the 1950s to the present day. It discusses the development of EU energy law; the application of general EU law into energy; the regulation of EU energy markets; international aspects of EU energy law; and policy, sustainability, and energy regulation. Presenting an up-to-date overview of EU energy law and policy and a critical analysis of its sub-areas, the book extends the discussion from electricity and natural gas markets to other areas of energy, including oil. This holistic approach to the subject is then placed within the broader context of the international geopolitical sphere which EU energy law and policy operates, as the author considers the impact of regional and international energy policies and markets on the EU markets and the overall EU policy. He also draws on the wider context and takes into account non-legal factors such as the impact of unconventionals, the rise of the BRICS, and the 'Arab spring'. The book frames EU energy law as a topic that can provoke intellectual, political, and professional discussion about the slowly moving train of economic regulation under the typical pressures and contradictions of countries and the European Union in the global economy.

Book excerpt: Expert testimony relying on scientific and other specialized evidence has come under increased scrutiny by the legal system. A trilogy of recent U.S. Supreme Court cases has assigned judges the task of assessing the relevance and reliability of proposed expert testimony. In conjunction with the Federal judiciary, the American Association for the Advancement of Science has initiated a project to provide judges indicating a need with their own expert. This concern with the proper interpretation of scientific evidence, especially that of a probabilistic nature, has also occurred in England, Australia and in several European countries. Statistical Science in the Courtroom is a collection of articles written by statisticians and legal scholars who have been concerned with problems arising in the use of statistical evidence. A number of articles describe DNA evidence and the difficulties of properly calculating the probability that a random individual's profile would "match" that of the evidence as well as the proper way to intrepret the result. In addition to the technical issues, several authors tell about their experiences in court. A few have become disenchanted with their involvement and describe the events that led them to devote less time to this application. Other articles describe the role of statistical evidence in cases concerning discrimination against minorities, product liability, environmental regulation, the appropriateness and fairness of sentences and how being involved in legal statistics has raised interesting statistical problems requiring further research.

Book excerpt: Mining and Energy Law is the only textbook available that encompasses a discussion of both the law and the policy of mining and resource regulation in existing and emergent areas, for the Commonwealth as well as for the states and territories in Australia. The book begins by examining the ownership framework underpinning natural resources within Australia and reviews the proprietary status and scope of mining tenements, and the regulation of offshore petroleum extraction. It goes on to explore the legal regimes that have emerged in response to more recent developments, such as coal seam gas, renewable energy and geo-sequestration. The book concludes with a discussion of the commercial and contractual arrangements commonly used by transacting parties operating in the sector. Mining and Energy Law is the ideal starting point for anyone seeking to understand the regulatory regimes and policy challenges relevant to one of Australia's most important industry sectors.

Book excerpt: Brings the concept of gross negligence to the fore and highlights how distributive justice forms a better foundation for risk allocation in the offshore energy industry Assessed the practice of risk allocation in gross negligence cases in offshore petroleum drilling contracts Presented a public policy perspective on risk allocation in offshore drilling contracts Discussed gross negligence as a sui generis risk and provides a definitional pathway for determining when gross negligence has occurred and how it should apply to offshore energy drilling contracts to encourage a pollution-free drilling operation Advanced the concept of distributive justice as a basis for risk allocation between participants when a downside arises due to gross negligence This book examines the practice of risk allocation in the offshore energy industry through the public policy lens and offers a novel perspective on the concept of gross negligence in risk allocation. This perspective is founded on the proportionality element of distributive justice in burden distribution. The assessment of how mutual indemnity clauses apply as an absolute shield against liability arising from gross negligence reveals that moral hazard can result from the practice. In the analysis, this book considers the risk allocation practice in PSC and Concession regimes and how parties' liability is determined in drilling contracts. This book considers gross negligence a sui generis risk and provides a definitional pathway for determining when gross negligence occurs and how it should apply to offshore drilling contracts. Thus, it advances an environmental sustainability approach to offshore petroleum drilling operations. This book will be useful to operators and contractors, resource-rich countries, insurance companies, practitioners, scholars, and academics interested in risk allocation in the petroleum industry.

Available in PDF, EPUB and Kindle. Book excerpt: Although the implications of EU membership have been the subject of intense political debate and academic enquiry throughout the member states, the actual impact of EU action on those states remains under-researched. The lack of empirical investigation has meant that it has not been possible to arrive at any informed judgement about how the EU has affected traditional policy making in the member states or to evaluate competing claims. The European Union and National Industrial Policy investigates the extent to which action at the EU level in a range of industrial, financial and service sectors has affected the substance of national policy and the behaiviour of, and relationships between, national actors. It looks at the policies pursued by the four larger member states in these areas, discussing the initiatives launched by the EU and assessing the Union's impact on national policy, compared with other internal and external factors. The European Union and National Industrial Policy offers a unique investigation of the relationship between the Union and member states that is empirically-based and theoretically reflective. In an attempt to overcome the boundaries that have traditionally seperated international relations, political science, public policy and other social sciences, it uses insights from a number of perspectives to assess the impact of the EU on the ability of member states to chose and implement their goals.

Available in PDF, EPUB and Kindle. Book excerpt: This title was first published in 2002: There is a multitude of assessment methods available for analyzing and reporting on the impacts of policies, all with different underlying assumptions and a wide range of criteria. Since the 1950s, much research has gone into creating guidelines for policy analysis, yet only a small percentage of evaluation has been carried out on transport policy - and none by political scientists or social policy specialists. The editors of this volume recognize that European integration has seen a drive to bring policy evaluation on to the transport agenda and has increased demands for ’strategic assessments’. It has become apparent that to gain a fuller understanding of the success of a transport programme, a much more complex combination of analytical methods must be used, and a set of guidelines specifically for the field of transport must be developed. This book achieves this by bringing together a multidisciplinary team of analysts from throughout the EU to discuss in a much broader way the various types of assessment methods and how they can best be used to evaluate transport programmes and systems, both individually and in combination.
