Diese muss nach Mill, sowohl vor politischen Einschränkungen als auch vor der Tyrannei der öffentlichen Meinung, geschützt werden. Mill geht davon aus, dass zu seiner Zeit die politische und soziale Freiheit des Individuums in besonderem Maße gefährdet ist. Diese Besorgnis entsteht bei ihm einerseits, durch die im „Viktorianischen Zeitalter“ besonders ausgeprägte orthodoxe Denken, welches insbesondere in Fragen der Religion und der Moral, bis in die privattesten Bereiche vordrang und jeden der sich nicht den gesellschaftlichen Konventionen fügte, zu einem Aussenseitertum zwängte.
