Book Synopsis The Spirit of Japanese Law by : John Owen Haley
Download or read book The Spirit of Japanese Law written by John Owen Haley and published by University of Georgia Press. This book was released on 2006 with total page 277 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Spirit of Japanese Law focuses on the century following the Meiji Constitution, Japan's initial reception of continental European law. As John Owen Haley traces the features of contemporary Japanese law and its principal actors, distinctive patterns emerge. Of these none is more ubiquitous than what he refers to as the law's "communitarian orientation." While most westerners may view judges as Japanese law's least significant actors, Haley argues that they have the last word because their interpretations of constitution and codes define the authority and powers they and others hold. Based on a "sense of society," the judiciary confirms bonds of village, family, and firm, and "abuse of rights" and "good faith" similarly affirms community. The Spirit of Japanese Law concludes with constitutional cases that help explain the endurance of community in contemporary Japan.

Book Synopsis Dominant Ideologies (RLE Social Theory) by : Bryan S. Turner
Download or read book Dominant Ideologies (RLE Social Theory) written by Bryan S. Turner and published by Routledge. This book was released on 2014-09-15 with total page 279 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this volume leading international scholars elaborate upon the central issues of the analysis of ideology: the nature of dominant ideologies. The ways in which ideologies are transmitted; their effects on dominant and subordinate social classes in different societies; the contrast between individualistic and collectivist belief systems; and the diversity of cultural forms that coexist within the capitalist form of economic organization. This book is distinctive in its empirical and comparative approach to the study of the economic and cultural basis of social order, and in the wide range of societies that it covers. Japan, Germany and the USA constitute the core of the modern global economy, and have widely differing historical roots and cultural traditions. Argentina and Australia are white settler societies on the periphery of the capitalist world-system and as a result have certain common features, that are cut across in turn by social and political developments peculiar to each. Britain after a decade of Thatcherism is an interesting test of the efficacy of an ideological project designed to change the cultural values of a population. Poland shows the limitations of the imposition of a state socialist ideology, and the cultural complexities that result.

Book Synopsis A History of Law in Japan until 1868 by : Carl Steenstrup
Download or read book A History of Law in Japan until 1868 written by Carl Steenstrup and published by BRILL. This book was released on 2021-12-06 with total page 219 pages. Available in PDF, EPUB and Kindle. Book excerpt: Japan's modern written law is Western. However, this law operates in a society whose values are pre-Western. In order to understand the function of modern law one has to study older systems of law as well. The main phases of Japan's pre-modern legal development are first, the indigenous customary law of the Yamato state. Next, the import and adaptation of Chinese codes from the 7th century onwards. Third, the use of Chinese legal techniques to bring order to the indigenous feudal law, culminating in the thirteenth century, and leading to the independence of Japan's legal system from that of China. Fourth, the mature system of written law and custom of the Tokugawa state. It is owing to the existence of well-functioning channels of law that Japan was able to modernise rapidly.
