Book Synopsis Constitutional Framework of European Labour Law in Italy, France, Germany, Portugal and Spain by : Luís Gonçalves da Silva
Download or read book Constitutional Framework of European Labour Law in Italy, France, Germany, Portugal and Spain written by Luís Gonçalves da Silva and published by Springer Nature. This book was released on 2024-01-02 with total page 160 pages. Available in PDF, EPUB and Kindle. Book excerpt: The challenges that labour law currently faces are well known. The emergence of new forms of work and the growing importance of technology in the age of the Fourth Industrial Revolution are important tests of the resilience of this field of law and its function: regulating the labour market. Therefore, it is becoming increasingly important to examine the fundamentals of labour law, especially how subordinate labour is addressed in various countries’ constitutions, in order to focus the analysis of the new phenomena affecting labour relations on their fundamental frameworks. In this context, this book puts forward an overarching framework that reflects how the Italian, German, French, Portuguese, and Spanish constitutions view labour in terms of both collective and individual relations – particularly the right to collective bargaining, the right to strikes and lock-outs, job security, and the right to remuneration – without losing sight of each Constitution's historical and political context. The aim of this book is therefore to provide an overview of the labour law frameworks in the constitutions of these legal systems and to show, by means of practical examples, how the law concretely implements them. Accordingly, it provides notes on the legal treatment of the topics analysed, serving as a practical guide for the study of these matters in the respective jurisdictions. This book will be of interest to all students and scholars of labour law looking for an overview of the topics covered in all five jurisdictions.

This book was released on 2013-06-29 with total page 564 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is intended to serve as a guide to businessmen and their advisers, either from outside the Common Market or from within, who seek basic information on questions in three main fields: company law and related legal matters, taxation, and labour law. For those who wish to establish an enter prise or form a holding or financing company in one of the Member States of the Common Market (including Greece, of course) or Switzerland this guide offers a unique opportunity to compare conditions in the various countries in the three fields. This is facilitated by the strict adherence to one format for each national chapter. Those who are already present in one or more of the eleven countries will find a global answer to a number of practical questions that may arise. For detailed answers the local lawyer or other consultant remains indispensable. The format is based on two different approaches the foreign investor may take: either he 'goes it alone', by way of establishing a branch, setting up a subsidiary or taking over an existing company, or he joins forces with another investor from within the host country or from outside. In the latter event there are a number of legal forms (jointly owned company, partnership, etc. ) which may be used.

The book is divided into two parts. Chapters in Part I present the ways in which each national jurisdiction deals with the group of organizations identified by the authors as “third sector organizations”, regardless of the ways in which these organizations are denominated or are commonly known in each country or the place in which their regulation is found. Chapters in Part II share a synthesis and comparative approach and draw the lines for further developments of the research activity culminated in the book.

Available in PDF, EPUB and Kindle. Book excerpt: This book offers a rethinking of the burgeoning research on not-for-profit organizations and socially responsible economics. Book Synopsis Labour Market Deregulation in Japan and Italy by : Hiroaki Richard Watanabe
Download or read book Labour Market Deregulation in Japan and Italy written by Hiroaki Richard Watanabe and published by Routledge. This book was released on 2014-11-13 with total page 191 pages. Available in PDF, EPUB and Kindle. Book excerpt: Japan and Italy encountered severe economic problems in the early 1990s, and the governments had to deal with those issues effectively under the increasing neoliberal pressures of globalisation. In this context, labour market deregulation was considered an effective tool to cope with those economic problems. However, the forms and degrees of labour market deregulation in the two countries were quite different. This book seeks to explain the differences in labour market deregulation policies between Japan and Italy, despite the fact that the two countries shared a number of similar political, social and labour market (if not cultural) characteristics. Uniquely, it takes a political, rather than economic or sociological perspective to provide a theoretical and empirical analysis of the processes of labour market deregulation in the two countries. The precarious working conditions of an increasing number of non-regular workers has become a prominent social issue in many industrialised countries including Japan and Italy, but the level of the protection for these workers depends on a country’s labour market policies, which are affected by the power resources of labour unions and labour policy-making structures. This book provides a useful perspective for understanding the root causes of this phenomenon, such as the diffusion of ‘neoliberal’ ideas aimed at promoting labour-market flexibility under globalisation, and demonstrates that there is still room for politics to decide the extent of deregulation and maintain worker protection from management offensives even in an era of globalisation. Labour Market Deregulation in Japan and Italy: Worker Protection under Neoliberal Globalisation will appeal to students and scholars of Japanese politics, Italian politics, political economy and comparative politics.
