Si bien todos los países se han visto afectadas por ellos y prácticamente todos los sectores de la actividad económica han recibido en mayor o menor medida flujos de inversión provinientes del extranjero, lo cierto es que sectores como el de la energía resultan paradigmáticos del proceso de incremento constante de los flujos transfronterizos de inversiones. Latinoamérica constituye un ejemplo sintomático de lo anterior. La inversión extranjera en el sector de la energía, en todas sus formas, ha sido constante y se ha ido incrementando con el paso del tiempo. En muchas ocasiones esta inversión tiene su origen en ciertos países emergentes -especialmente China- y se ha producido a través del uso de Fondos Soberanos o Empresas estatales. Si bien hasta el momento las inversiones extranjeras han sido ampliamente aproximadas de manera positva, en los últimos años se ha producido una tendencia a introducir ciertos controles en relación con ella o, al menos, respecto de cierta inversión proviniente de ciertos países. Esto ha planteado a los Estados un difícil equilibrio entre la libertad de inversione, la protección de la seguridad nacional y el fomento de un cierto nacionalismo energético como forma de preservar las riquezas naturales de un país. El presente artículo, primer capítulo de un libro dedicado enteramente al análisis del régimen jurídico de las inversiones extranjeras en todos y cada uno de los países latinoamericanos, analiza en profundidad este fenómeno y establece algunas pautas imprescindibles para aproximarlo.
