Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Introduction to the Science of Law, 1911: Systematic Survey of the Law and Principles of Legal Study Speaking broadly, we may arrange jurists in three groups or schools: philosophical, historical and analytical. To the philosophical jurist, law is the expression of an idea. It is an expression of right and justice, found rather than made by legislator or judge or text-writer. Or, as the Neo-Hegelians put it, it is the expression of the culture of a people in the form of principles for the government of men's external relations to one another. To the historical jurist also law is found not made; but in his view something different is found. To him a principle of human action has been found by human experience and is developed as a rule of law. To the analytical jurist, on the other hand, law at least in its matured form and in developed communities, is the product of conscious and determinate human will. The lines between these schools, however, are by no means as sharp as formerly. In England, the analytical and historical schools have been tending to a common ground. In Germany the philosophical and historical schools have been approaching each other. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. This book is designed for a temporary aid during this period. It is a collection of such information as the author has felt "would be of particular assistance to students just entering upon the study of law." It explains in simple language those fundamental principles and truths which the student meets from the first. The relation of law to morality, the difference between authority and dictum, the desirability of following precedent, etc. - all these matters are considered. The writer outlines the difference between law and equity, and gives a brief historical summary of their development. The different kinds of law books, their uses, and abbreviations, are touched upon. The relations of the different courts to each other are mentioned. The author has succeeded in putting what he has to say into an attractive and concise form, and while the book is hardly one for careful study, it will repay reading. -Harvard Law Review, Vol. 12

Available in PDF, EPUB and Kindle. Book excerpt: In this important work, Dr. Felipe Fierro offers a comprehensive view on the subject of Introduction to the Study of Law, in which he revives the use of Gnoseology, Philosophy, History and Logic as Auxiliary Sciences; and exposes how the abandonment of such has contributed to the exponential growth of Skepticism and Relativism, currently prevailing in the legal world. The above, through extensive experience in teaching Law from the Aristotelian-Thomistic platform, based on the elementary assumption that we must first prove the existence of the object of study, and contrast main legal branches in topics such as: what is Law?, why is Science?, what are Law, Justice, Facultative rights and the Common Good?; supported by extensive and select bibliography. In addition, the being, nature, concept, essence and properties of the sources, fundamentals and classification are described. But important elements such as knowledge, order, principles, Jurisprudence, and Natural law, fundamental legal concepts, the legislative process, the Constitution, interpretation and others are not absent. Morality and Legal Law are obligatory markers, which although considered in their own field, are not excluded, but different as to object and method. Predominantly, Justice is exposed as one of the great values of the Law, and main theories in order to offer future lawyers the basis regarding the current Science of Law and its significance.

In five chapters, the book analyses and explores: (i) legal methodology in general, the main features of different schools of thought, and the nature of science in general; (ii) American realism, which offers an ideal starting point for law students to reflect on the material they are about to study critically; (iii) rationalism, empiricism, and logical positivism, in particular the work of Karl Popper; (iv) criticisms of essentialism; (v) the ideological and philosophical background of contemporary liberal interpretation. The inclusion of Dutch, French, and German literature sources makes this law title differ from previous writings on legal science. This textbook is ideal for students of legal method, and will be of great interest to those studying legal science, jurisprudence, legal research, and legal skills.
