Available in PDF, EPUB and Kindle. Book excerpt: The 1982 U.N. Convention of the Law of the Sea took over a decade to produce and was the final result of the largest single international negotiating process undertaken before or since that time. As the world's leading maritime nation, the U.S. has vital, immediate, national interests in the Convention and in the continuing refinement of maritime law based upon the tenets of that comprehensive document. The present work describes in detail the concurrent development of international law and the law of the sea, the complex negotiating process that resulted in the completed Convention, the role of the U.S. both during the Law of the Sea Convention and during the decade of negotiation that finally made the Convention acceptable, and policy directions and issues for the U.S. in the post-Convention environment. This is an important new text in international law, international relations, and maritime affairs.

Available in PDF, EPUB and Kindle. Book excerpt: The Law of the Sea Convention: US Accession and Globalization, provides valuable insight into a number of contemporary and pressing issues concerning the world’s oceans and their management. Organized into two major sections, Part l presents the findings of senior-level experts addressing the fact that the United States is not a Party to the United Nations Convention on the Law of the Sea, 1982 (UNCLOS). Brought together on the occasion of the 34th Annual Conference of the Center for Oceans Law and Policy, University of Virginia School of Law (COLP), panels considered the impact of the lack of US participation in UNCLOS, evaluating topics such as energy and economic development, including the undersea cable industry, as well as ramifications for U.S. national security and navigational rights. Part ll of the volume examines key trends in commercial shipping, piracy and terrorism, islands and rocks, safety and navigational freedom, marine scientific research, and emerging global oceans policy issues. Presented by a diverse group of experts, the work brings together the results of an international meeting co-sponsored by the Korea Maritime Institute, the Netherlands Institute for the Law of the Sea and COLP. Collectively, the work included in this important volume contributes to the existing literature and will be of interest to scholars, practitioners and the policy community.

Book excerpt: This textbook provides the reader with a foundation in policy development and analysis and describes how policy, including legal mechanisms, is applied to marine environments around the world. It offers a systematic treatment of all aspects of marine policy, including environmental protection, fisheries, transportation, energy, mining and climate change. It starts with a biophysical overview of the structure and function of the marine environment with a particular emphasis on the challenges and opportunities of managing the marine environment. An overview of the creation and function of international law is then provided with a focus on international marine law. It explores the geographic and jurisdictional dimensions of marine policy, as well the current and anticipated challenges facing marine systems, including climate change-related impacts and resource over-exploitation. The book should appeal to senior undergraduate and graduate students and form a core part of the curriculum for marine affairs, science and policy courses. It will also provide supplementary reading for students taking a course in the law of the oceans, but is not aimed at legal specialists.

Available in PDF, EPUB and Kindle. Book excerpt: "Oceans Policy: New Institutions, Challenges and Opportunities" draws attention to three new international institutions created by the 1982 Convention on the Law of the Sea. The International Seabed Authority located in Jamaica governs global activities to convert polymetallic resources into reserves of metal. The Legal Counsel for the Authority provides the first public review of the Authority's draft Mining Code containing the rules, regulations, and procedures for deep seabed mining. The second institution dealt with is the International Tribunal for the Law of the Sea. Professor Louis Sohn outlines several innovative uses of advisory opinions available to the Tribunal while the President of the Tribunal reports on a busy first year of work by this new institution located in Hamburg. Other items discussed are the jurisdiction of the Tribunal and its working methods, including its rules, proceedings and internal procedures. The third international institution established to implement the 1980 Convention is the Commission on the Limits of the Continental Shelf beyond 200 nautical miles. An explanation is given of the geographical context for the development of the legal concept of the Continental Shelf. The principal problems that the Commission must resolve are summarized, in particular with respect to the definition in the Convention of the outer limit of the Continental Shelf. The fourth part of this work is focused on the global challenges posed by drug trafficking in the Caribbean region. The international legal framework governing intercepting illegal drug shipments at sea is analyzed. Recent counter-drug initiatives undertaken at the International Maritime Organization are thenreviewed. The book also contains discussion of the growing threat to ocean freedom posed by piracy and armed robbery at sea, as well as the increasing problems in reconciling the rules for salvage of shipwrecks and underwater archeology. The publication is based on a conference held in Jamaica that was organized by the Center for Oceans Law and Policy, University of Virginia School of Law.

Book excerpt: In the years since 1994, when the UN Convention on the Law of the Sea (UNCLOS) entered into force, the ocean law regime has been profoundly affected by an interplay of new forces in global ocean affairs. Numbered among them are innovations in technology and science, the emergence of intensified piracy and other challenges to maritime security, national, and regional programs. In Ocean Law and Policy: Twenty Years of Development under the UNCLOS Regime, experts from fourteen countries present nineteen papers that provide insightful analyses of these wide-ranging issues that form the emerging new context of UNCLOS as a keystone to a working regime system. Accessible as well as authoritative, this volume offers to general readers as well as academics, policy officials, and legal experts a set of important analyses and provocative insights, forming a major contribution to the literature of ocean studies.

Book excerpt: The most current text available on the international and U.S. law of the sea, this much-needed reference is built around the 1982 United Nations Convention on the Law of the Sea and other relevant maritime materials. While it addresses all aspects of ocean usage, much emphasis has been placed on issues of contemporary importance such as international fisheries, maritime boundaries, and deep seabed mining. The first part introduces traditional zones of jurisdiction and doctrine such as inland waters, territorial seas, or high seas, as well as some new concepts related to navigation: the regimes of international straits and archipelagic waters and exclusive economic zones. The latter part analyzes functional issues such as fishing, oil and gas exploitation, mining, scientific research, and maritime pollution, referring on each subject to the U.S. law for comparison.

Book excerpt: Volume III is the fourth substantive volume to be published in this series, covering articles 86 to 132 of the 1982 Convention. These articles address the issue of States' rights and jurisdiction in maritime areas beyond the limits of national jurisdiction (with the exception of the international seabed area), as well as the regime to be applied to islands, in enclosed and semi-enclosed seas, and with the access of landlocked States to and from the sea. Volume III is a direct continuation of Volume II, which deals with maritime areas under the sovereignty of jurisdiction of a State, and completes the commentary on the provisions of the Convention negotiated under the auspices of the Second Committee at UNCLOS III. The work of the Second Committee was an integrated whole, and the unity of the theme has been spread over two volumes solely as a matter of convenience. A number of documentary annexes have been included in this volume.

Available in PDF, EPUB and Kindle. Book excerpt: Coastal and Ocean Management Law in a Nutshell surveys the continually evolving law of the coasts and oceans. The material is unique because it does not analyze the law of a discreet substantive field of law, but instead looks at the law in relation to a place - the coasts and oceans. These areas are viewed from common law and modern regulatory perspectives, from the federal and state levels, and from an international perspective. Starting with principles of the common law concerning the public trust doctrine and ownership of waters and coastal lands, the book moves to modern issues of beach access, coastal development and regulation of coastal resources, and the Coastal Zone Management Act. Offshore resource management issues, including outer continental shelf oil development and mining, fisheries, historic wrecks, navigation and pollution control, and protection of marine species are also surveyed. Finally, recent developments in the law of the sea and the United States' ocean law and policy responses are reviewed.
