Today, it ranks 133rd out of 148 countries in global competitiveness. Its economy is as dysfunctional as its political system is corrupt; both rely heavily on international aid for their existence. Taliban forces occupy 30 percent of the country. It possesses over a hundred nuclear weapons that could easily fall into terrorists' hands. Why, in an era when countries across the developing world are experiencing impressive economic growth and building democratic institutions, has Pakistan been such a conspicuous failure? In The Warrior State, noted international relations and South Asia scholar T.V. Paul untangles this fascinating riddle. Paul argues that the "geostrategic curse"--akin to the "resource curse" that plagues oil-rich autocracies--is at the root of Pakistan's unique inability to progress. Since its founding in 1947, Pakistan has been at the center of major geopolitical struggles: the US-Soviet rivalry, the conflict with India, and most recently the post 9/11 wars. No matter how ineffective the regime is, massive foreign aid keeps pouring in from major powers and their allies with a stake in the region. The reliability of such aid defuses any pressure on political elites to launch the far-reaching domestic reforms necessary to promote sustained growth, higher standards of living, and more stable democratic institutions. Paul shows that excessive war-making efforts have drained Pakistan's limited economic resources without making the country safer or more stable. Indeed, despite the regime's emphasis on security, the country continues to be beset by widespread violence and terrorism. Book excerpt: The bills of rights adopted in the Commonwealth countries of Canada, New Zealand, the United Kingdom and, at the subnational level, Australia in recent decades, have prompted scholars and institutional actors involved in the process of constitutional design and reform to rethink how to evaluate and compare the different approaches to human rights protection. They have challenged a number of assumptions in the field, for example, that courts must have the power to invalidate laws that are found to violate rights (ie courts can now be given non-binding powers), that courts must have the 'final word' on rights issues (ie legislatures can now be given the power to override judicial decisions) and that bills of rights are enforced exclusively by courts (ie legislators can now be given new responsibilities to ensure that the laws they enact are compatible with rights).This book addresses three questions arising from these developments. How do these new bills of rights differ from the traditional approaches to rights protection? Why, if at all, should we consider the Commonwealth's approach over the traditional approaches? What compromises must be struck in the course of adopting a bill of rights of this variety? In answering these questions, the book sets out a new framework for comparison that focuses on the types of inter-institutional disagreement facilitated by and found in the different approaches to rights protection. It also identifies a previously unrecognised element of the Commonwealth's approach - the normative trade-offs with other constitutional principles and values - that is pivotal to understanding its operation. While migration has become an all-important topic of discussion around the globe, mainstream literature on migrants' legal adaptation and integration has focused on case studies of immigrant communities in Western-style democracies. We know relatively little about how migrants adapt to a new legal environment in the ever-growing hybrid political regimes that are neither clearly democratic nor conventionally authoritarian. This book takes up the case of Russia—an archetypal hybrid political regime and the third largest recipients of migrants worldwide—and investigates how Central Asian migrant workers produce new forms of informal governance and legal order. Migrants use the opportunities provided by a weak rule-of-law and a corrupt political system to navigate the repressive legal landscape and to negotiate—using informal channels—access to employment and other opportunities that are hard to obtain through the official legal framework of their host country. This lively ethnography presents new theoretical perspectives for studying immigrant legal incorporation in similar political contexts.

While the Nordic countries are listed at the top in most international rankings of gender equality and citizens’ feelings of security, studies on the prevalence of sexual victimisation present a different picture, suggesting that the very countries that have invested much in establishing gender equality actually see a high prevalence of sexual violence. This book sheds light on the phenomenon and construction of rape and other forms of sexual violence within the Nordic region, exploring the ways in which rape and sexual violence are dealt with through criminal law and considering governmental policies aimed at combatting it, with a special focus on legal regulations and developments. Thematically organised, it offers new research on perpetrators, victimhood, criminal justice and prevention.
