Available in PDF, EPUB and Kindle. Book excerpt: Every Assistance and Protection is the first book presenting an in-depth history of the Australian passport. In charting the development of the passport from its early beginnings to its present form, the book traverses changes in government policy and social history from the early 19th century to the modern era. It shows how the Australian passport evolved from a signifier of British nationality into a badge of membership of one of the most multicultural countries in the world. The book explores the landmark events in this history:the great 19th century diasporas, resulting from relaxation of official controls on the movement of people; the early passport regime regulating the movement of "ticket-of-leave" convicts; the establishment of the centralised passport system during World War I; the enactment of the first passport legislation for the Commonwealth, The Passports Act 1920, and the reaction of some Australians who felt the new law infringed the liberties of the British subject; changes to the laws in 1938 such that possession of a passport was no longer mandatory for an Australian to travel, though still a practical necessity; the use of the government's discretionary power to cancel or withhold passports to inhibit the movement of individual communists; the establishment of Australian citizenship in 1948 - the basis for possession of an Australian passport; the removal of the word "British" from the cover in 1967; the effects of globalisation and heightened security in the late 20th and early 21st century. It also touches on the lives of individuals: boxer Les Darcy, journalist Wilfred Burchett, and General Sir Thomas Blamey, are among the many Australians featuring in these pages. The book is based on an exhaustive examination of hitherto unexamined primary sources of many government departments, including the Departments of External Affairs, the Prime Minister's, the Attorney-General's, Defence, Home and Territories, Immigration and Foreign Affairs. Available in PDF, EPUB and Kindle. Book excerpt: This book provides the first detailed analysis of the decision to prosecute made by the statutory Australian Offices of Director of Prosecution. It examines the system of prosecution as part of the executive branch of government, and the role and challenges of the individual prosecutors who make decisions within the system. It explores the tension between prosecutorial independence and prosecutorial accountability, and the paradox that political involvement in prosecutions is necessary for accountability and to uphold the public interest, but can compromise independence. The book makes a unique contribution to both Australian criminal law scholarship and to the international literature on criminal prosecution, by drawing on the sub-disciplines of criminal law and administrative law. It includes case studies on prosecuting child sexual abuse, rape, and government espionage, and comparisons with common law and civil law countries including the USA, the UK, Italy and South Africa.

Available in PDF, EPUB and Kindle. Book excerpt: This edited collection brings together leading scholars to comparatively investigate national security, surveillance and terror in the early 21st century in two major western jurisdictions, Canada and Australia. Observing that much debate about these topics is dominated by US and UK perspectives, the volume provides penetrating analysis of national security and surveillance practices in two under-studied countries that reveals critical insights into current trends. Written by a wide range of experts in their respective fields, this book addresses a fascinating array of timely questions about the relationship among national security, privacy and terror in the two countries and beyond. Chapters include critical assessments of topics such as: National Security Intelligence Collection since 9/11, The Border as Checkpoint in an Age of Hemispheric Security and Surveillance, Unmanned Aerial Vehicles and Law Enforcement, as well as Federal Government Departments and Security Regimes. An engaging and empirically driven study, this collection will be of great interest to scholars of security and surveillance studies, policing, and comparative criminology.

This book was released on 2021-03-05 with total page 378 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the way in which undercover police investigation has come to be regulated in Australia. Drawing on documentary and doctrinal legal analysis, this book investigates how, in the space of a single decade, Australian law makers set out to regulate one of the most difficult aspects of police: undercover investigation. In so doing, the Australian experience represents a paradigm model. And yet despite its success, it is a system of law and practice that has a dark side – a model of investigation to relies heavily on activities that are unlawful in the absence of authorisation. It is a model that is as much concerned with the surveillance and control of police as it is with suspected criminal conduct. The book aims to locate the Australian experience in comparative perspective with other major common law jurisdictions (the United Kingdom, Canada and New Zealand), with a view to contrast strengths, similarities and weaknesses of these models. It is argued that the Australian model, at the pragmatic level, offers a highly successful model for regulatory structure and practice, providing a significant model for successful regulation. At the same time, the model that has been introduced raises important questions about how and why the Australian experience evolved in the way that it did, and the implications this has for the relationship between citizen and state, the judiciary and the executive, and broader questions about the protections offered by rights discourse and jurisprudence. This book aims to document the law, policy and practices that shape undercover investigations. In so doing, it aims to not only articulate the way in which the law regulates these activities, but also to move on to consider some of the fundamental questions linked to undercover investigations: how did regulation happen? By what means of regulation? What are the driving policy issues that give this field of law its particular complexion? What are the implications? Who gains, and who loses, by which means of power? The book offers unique insights into a largely unknown aspect of modern covert policing, identifying a range of practices, the legal framework, controversies and powers. By locating these practices in a rich theoretical context, informed by risk and governmentality scholarship, this book offers a legal and theoretical explanation of one of the most controversial forms of policing.
