Book excerpt: The concepts of humanity, human dignity and mankind have emerged in different contexts across international law and biolaw. This raises many different questions. What are the aims for which 'humanity' is mobilised? How do these aims affect the ensuing interpretations of this concept? What are the negative counterparts of humanity, mankind and human dignity? And what happens if a concept developed in one particular context is taken up in another? By bringing together research from international law, biolaw and legal theory, this volume answers such questions by analysing how the concepts overlap and contradict each other across the disciplines. The result is not an examination of what humanity is but rather what it does and what it brings about in a variety of contexts.

Available in PDF, EPUB and Kindle. Book excerpt: This book describes the rule of law as the reign of persuasion rather than the reign of force, and democracy as the reign by persuasion rather than the reign by force. It synthesizes a vast amount of current Cassirer-literature and makes a contribution to jurisprudence. The book is the first systematic elaboration on law as a symbolic form and it sheds new light on a still dark area of intellectual and jurisprudential thought.

Available in PDF, EPUB and Kindle. Book excerpt: Braithwaite's argument against punitive justice systems and for restorative justice systems establishes that there are good theoretical and empirical grounds for anticipating that well designed restorative justice processes will restore victims, offenders, and communities better than existing criminal justice practices. Counterintuitively, he also shows that a restorative justice system may deter, incapacitate, and rehabilitate more effectively than a punitive system. This is particularly true when the restorative justice system is embedded in a responsive regulatory framework that opts for deterrence only after restoration repeatedly fails, and incapacitation only after escalated deterrence fails. Braithwaite's empirical research demonstrates that active deterrence under the dynamic regulatory pyramid that is a hallmark of the restorative justice system he supports, is far more effective than the passive deterrence that is notable in the stricter "sentencing grid" of current criminal justice systems.

Available in PDF, EPUB and Kindle. Book excerpt: Conspicuously, Islam has become a key concern in most European societies with respect to issues of immigration, integration, identity, values and inland security. As the mere presence of Muslim minorities fails to explain these debates convincingly, new questions need to be asked: How did »Islam« become a topic? Who takes part in the debates? How do these debates influence both individual as well as collective »self-images« and »image of others«? Introducing Switzerland as an under-researched object of study to the academic discourse on Islam in Europe, this volume offers a fresh perspective on the objective by putting recent case studies from diverse national contexts into comparative perspective.

Available in PDF, EPUB and Kindle. Book excerpt: This interesting volume focuses on a set of phenomena which increasingly alarm the political world and public opinion: from the more obvious ones like torture, disease, human trafficking, abuse, genocide, displacement, to more subtle forms found in sports, technology and law. It looks at how and why these phenomena are universally condemned, and could be considered to threaten the very foundations of modern democracy; yet continue to be tolerated. The volume therefore goes beyond what Hannah Arendt has called the "banality of evil" and discusses the presence of condemned and heinous practices in society as fluid and chaotic but as non-trivial; capable of great transmutations through various epochs. Practices and actions considered as "evil" manifest in situations where individuals or groups hold power or seize power, and the contributions in this volume explore the close relation between power and evil. The volume draws upon sociology, psychology, cultural studies, political science, as well as philosophy, theology, anthropology, and neurology of the individual and of the group to provide a comprehensive understanding of the multiple facets of evil in the contemporary world.

Book excerpt: At once a slogan and a vision for future scholarship, interdisciplinarity promises to break through barriers to address today's complex challenges. Yet even high-stakes projects often falter, undone by poor communication, strong feelings, bureaucratic frameworks, and contradictory incentives. This new book shows newcomers and veteran researchers how to craft associations that will lead to rich mutual learning under inevitably tricky conditions. Strikingly candid and always grounded, the authors draw a wealth of profound, practical lessons from an in-depth case study of a multiyear funded project on cultural property. Examining the social dynamics of collaboration, they show readers how to anticipate sources of conflict, nurture trust, and jump-start thinking across disciplines. Researchers and institutions alike will learn to plan for each phase of a project life cycle, capturing insights and shepherding involvement along the way.
