Book excerpt: The Government utilizes the contract process to purchase a wide variety of goods and services. These include existing commercial products and services, the design, development, and manufacture of goods and related services necessary to meet specific Government needs. Additionally, the government provides financial assistance through grants and cooperative agreements to support research and development by private and public entities, and conducts and collaborates in research and development activites with private sponsors at Government facilities. Through this large expenditure of funds, there is substantial contact with intellectual property. This material principally deals with the relationship between intellectual property concepts of patent, trade secrets, and copyrights and the Government's procurement and financial assistance processes. The subject of trademarks is not covered.

Book excerpt: The presence of a robust public domain is an essential precondition for cultural, social and economic development and for a healthy democratic process. But the public domain is under pressure as a result of the ongoing march towards an information economy. Items of information, which in the `old economy had little or no economic value, such as factual data, personal data, genetic information and pure ideas, have acquired independent economic value in the current information age, and consequently become the object of property rights making the information a tradable commodity. How and to what extent does the commodification of information affect the free flow of information and the integrity of the public domain? Does the freedom of expression and information, guaranteed inter alia in the European Convention on Human Rights, call for active state intervention to `save the public domain? What means both legal and practical are available or might be conceived to guarantee and foster a robust public domain? These were the main questions that were addressed in a major collaborative research project led by the Institute for Information Law of the University of Amsterdam (IViR) in co-operation with the Tilburg Institute for Law, Technology and Society (TILT) of Tilburg University, and funded by ITeR, the Dutch National Program for Information Technology and Law. Thirteen contributions from academia worldwide make up the present book, addressing the future of the public domain from a different angle. In addition, all authors were invited to reflect upon the notion and role of the public domain in the context of information law and policy. Should this concept be limited to that of a `negative image of (intellectual) property protection, i.e. all publicly available information not subject to a property right, and therefore freely (i.e. gratis) available, or should a broader approach be taken, e.g. all information available from public sources at affordable cost? Should information policies be aimed at maximizing the public domain or optimizing information flows? To what extent are these aims congruent? This book takes a broader, `information law oriented approach towards the question of preserving the public domain, in which a wide range of interrelated legal questions converge. Issues treated in this book include: Economic analysis of the public domain Fundamental rights analysis of the public domain Impact of the application of technological protection measures and contractual restrictions on the public domain The impact of the expansion of copyright, database right and patent rights on the public domain The impact of the commodification of private data, government information, indigenous knowledge on the public domain The capacity of the Open Source and Creative Commons Movements to preserve the integrity of the public domain The Future of the Public Domain is an important work for all those interested or involved in the regulation of the knowledge economy. Legal scholars, academic and research institutions, corporate counsel, lawyers, government policymakers and regulators all these and more will benefit enormously from the thoughtful and incisive discussions presented here.

Book excerpt: The digitization of industrial processes has suddenly taken a great leap forward, with burgeoning applications in manufacturing, transportation and numerous other areas. Many stakeholders, however, are uncertain about the opportunities and risks associated with it and what it really means for businesses and national economies. Clarity of legal rules is now a pressing necessity. This book, the first to deal with legal questions related to Industrial Internet, follows a multidisciplinary approach that is instructed by law concerning intellectual property, data protection, competition, contracts and licensing, focusing on business, technology and policy-driven issues. Experts in various relevant fields of science and industry measure the legal tensions created by Industrial Internet in our global economy and propose solutions that are both theoretically valuable and concretely practical, identifying workable business models and practices based on both technical and legal knowledge. Perspectives include the following: regulating Industrial Internet via intellectual property rights (IPR); data ownership versus control over data; artificial intelligence and IPR infringement; patent owning in Industrial Internet; abuse of dominance in Industrial Internet platforms; data collaboration, pooling and hoarding; legal implications of granular versioning technologies; and misuse of information for anticompetitive purposes. The book represents a record of a major collaborative project, held between 2016 and 2019 in Finland, involving a number of universities, technology firms and law firms. As Industrial Internet technologies are already being used in several businesses, it is of paramount importance for the global economy that legal, business and policy-related challenges are promptly analyzed and discussed. This crucially important book not only reveals the legal and policy-related issues that we soon will have to deal with but also facilitates the creation of legislation and policies that promote Industrial-Internet-related technologies and new business opportunities. It will be warmly welcomed by practitioners, patent and other IPR attorneys, innovation economists and companies operating in the Industrial Internet ecosystem, as well as by competition authorities and other policymakers.

Available in PDF, EPUB and Kindle. Book excerpt: How does law protect your ideas and privacy in Scotland and the UK? The Scots common law of property is strongly realist in its concepts, and restricts itself to tangible objects - objects, land, things attached to the land. But what about non-physical property, such as your intellectual property and your private personal information? These types of property are of increasing importance in this technological age. From copyright to patents, from data protection to freedom of information, and from e-commerce to cybercrime, Intellectual Property Law Essentials explains how UK statue law protects and regulates your information and ideas. End-of-chapter summaries of essential facts highlight the key things you should have learned, and summaries of essential cases show how the law is enforced in practice.

Book excerpt: IP and Technology in Government Contracts: Procurement and Partnering at the Federal and State Level (2015 Edition) by James G. McEwen, David S. Bloch, Richard M. Gray, and John T. Lucas. State and national governments often meet their technologically-intensive needs by entering into contracts and financing deals with private companies. These contracts, and the complex rules that accompany them, have elevated the risk of intellectual property loss for private-sector contractors. IP and Technology in Government Contracts provides a comprehensive appraisal of United States federal procurement laws relating to intellectual property, plus a detailed survey of state procurement rules and a comparison of the approaches adopted by the European Union and other industrialized countries. It provides strategic guidance for the protection of IP in government contracts, and the various ways to enforce IP rights in the event of government violation. Written by knowledgeable and highly-experienced professionals in the field, this book offers detailed advice and commentary concerning strategies, opportunities, and traps for the unwary. This book assists attorneys on both sides of the equation to approach government deals with the dual objectives to maximize the tremendous upside potential while protecting IP rights. This edition has been revised to address important changes in underlying statutes (including the America Invents Act), regulations (including important revisions to the FAR and DFARS), and major new judicial decisions (including the implications of the Supreme Court's first Bayh-Dole case, Stanford University v. Roche, and the latest Zoltek decisions). There is substantial new guidance on specially negotiated rights, including a draft model license with detailed explanations of how each clause is to be used, and detailed guidance on the alternative clauses in FAR, DFARS, and DEAR. Finally, the chapters on enforcement and state procurement have been substantially updated to reflect new laws and decisions. Features 0́Ø Multifaceted investigation of U.S. federal and state level IP procurement practices, providing valuable advice to attorneys on both sides of intellectual property litigation in government contracts 0́Ø Provides practical guidance to avoid pitfalls of government IP contracting, and remedies for government misuse of IP rights 0́Ø Written by four prominent intellectual property specialists whose combined experience spans the private and government sectors 0́Ø Comprehensively updated, rewritten, and revised to reflect new developments in federal intellectual property and procurement law over the last 3 years, with dramatically expanded coverage of civilian agencies 0́Ø Revised and updated analysis of IP and procurement laws in all 50 States and the District of Columbia. 0́Ø Expanded coverage of administrative claims procedures. 0́Ø New discussions of government out-licensing of IP and uses of open-source software 0́Ø Expanded guidance and templates for negotiating specialized IP licenses Reviews "McEwen, Bloch and Gray have compiled a detailed, comprehensive, and path-breaking guide to the complex landscape at the intersection of government procurement and intellectual property. It is destined to become an essential navigation aide to all who work in this important area." --Robert Brauneis, Associate Professor of Law & Co-Director of the IP Law Program, The George Washington University Law School "This work will prove a valuable resource to attorneys practicing in the field of government procurement of intellectual property for a very long time to come." --Danielle Conway-Jones, Professor of Law & Director, University of Hawaii Procurement Institute, William...

Book excerpt: Information technology is a powerful tool for meeting environmental objectives and promoting sustainable development. This collection of papers by leaders in industry, government, and academia explores how information technology can improve environmental performance by individual firms, collaborations among firms, and collaborations among firms, government agencies, and academia. Information systems can also be used by nonprofit organizations and the government to inform the public about broad environmental issues and environmental conditions in their neighborhoods. Several papers address the challenges to information management posed by the explosive increase in information and knowledge about environmental issues and potential solutions, including determining what information is environmentally relevant and how it can be used in decision making. In addition, case studies are described and show how industry is using information systems to ensure sustainable development and meet environmental standards. The book also includes examples from the public sector showing how governments use information knowledge systems to disseminate "best practices" beyond big firms to small businesses, and from the world of the Internet showing how knowledge is shared among environmental advocates and the general public.
