Book excerpt: The presence of a robust public domain is an essential precondition for cultural, social and economic development and for a healthy democratic process. But the public domain is under pressure as a result of the ongoing march towards an information economy. Items of information, which in the `old economy had little or no economic value, such as factual data, personal data, genetic information and pure ideas, have acquired independent economic value in the current information age, and consequently become the object of property rights making the information a tradable commodity. How and to what extent does the commodification of information affect the free flow of information and the integrity of the public domain? Does the freedom of expression and information, guaranteed inter alia in the European Convention on Human Rights, call for active state intervention to `save the public domain? What means both legal and practical are available or might be conceived to guarantee and foster a robust public domain? These were the main questions that were addressed in a major collaborative research project led by the Institute for Information Law of the University of Amsterdam (IViR) in co-operation with the Tilburg Institute for Law, Technology and Society (TILT) of Tilburg University, and funded by ITeR, the Dutch National Program for Information Technology and Law. Thirteen contributions from academia worldwide make up the present book, addressing the future of the public domain from a different angle. In addition, all authors were invited to reflect upon the notion and role of the public domain in the context of information law and policy. Should this concept be limited to that of a `negative image of (intellectual) property protection, i.e. all publicly available information not subject to a property right, and therefore freely (i.e. gratis) available, or should a broader approach be taken, e.g. all information available from public sources at affordable cost? Should information policies be aimed at maximizing the public domain or optimizing information flows? To what extent are these aims congruent? This book takes a broader, `information law oriented approach towards the question of preserving the public domain, in which a wide range of interrelated legal questions converge. Issues treated in this book include: Economic analysis of the public domain Fundamental rights analysis of the public domain Impact of the application of technological protection measures and contractual restrictions on the public domain The impact of the expansion of copyright, database right and patent rights on the public domain The impact of the commodification of private data, government information, indigenous knowledge on the public domain The capacity of the Open Source and Creative Commons Movements to preserve the integrity of the public domain The Future of the Public Domain is an important work for all those interested or involved in the regulation of the knowledge economy. Legal scholars, academic and research institutions, corporate counsel, lawyers, government policymakers and regulators all these and more will benefit enormously from the thoughtful and incisive discussions presented here.

Book excerpt: This prospective paper is about 'after the triumph', a short-hand for a much larger and more powerful idea, namely, the return, reconstitution and redeployment of the public domain in a post-Seattle and post-Washington consensus world order (Williamson 1990, 1999). The emergence of the global economy with its predilection for market fundamentals, tough zero-inflation bench-marking, an unstoppable political dynamic of one worldism and silence on the need for an expansive notion of the public sphere is unquestionably the watershed event of our times. The meta-narrative of globalization has no rivals as the last grand political discourse of the twentieth century and if we understand anything about the endless capacity of the globalization narrative to reinvent itself in a new guise when conditions demand it, today is one of those defining moments. A new kind of state is emerging with its own particular institutions, practices and innovative forms as theorized by Held (1995) and Castells (1996). Yet after the battle in Seattle and the 2008 global financial crisis, the future prospects of 'market fundamentalism' are increasingly troubled. A turning point has been reached in the debate over the rising costs and elusive benefits of globalization. The contemporary rebundling of identity and territory makes available policy space for the re-entry of the public domain. If there are to be clear sites of national authority and a stable international community, the re-emergence of the public domain, in which consensus, co-operation and public discourse figure predominately, has a compelling, if neglected, role to play as one of the co-ordinates that will rebundle 'identity and territory' in Ruggie's evocative words. With material and institutional dimensions that are large and complex with overlapping aspects, the public domain should not be used interchangeably with the public sector, with which it is often confused. Nor should it be limited to the provision of public goods, a staple of modern economic liberalism. In the primary sense of the term, the public domain is about the resources carved out from the market that empower and transform both the state and non-state actors.

Book excerpt: Digital technologies and networks are now part of everyday work in the sciences, and have enhanced access to and use of scientific data, information, and literature significantly. They offer the promise of accelerating the discovery and communication of knowledge, both within the scientific community and in the broader society, as scientific data and information are made openly available online. The focus of this project was on computer-mediated or computational scientific knowledge discovery, taken broadly as any research processes enabled by digital computing technologies. Such technologies may include data mining, information retrieval and extraction, artificial intelligence, distributed grid computing, and others. These technological capabilities support computer-mediated knowledge discovery, which some believe is a new paradigm in the conduct of research. The emphasis was primarily on digitally networked data, rather than on the scientific, technical, and medical literature. The meeting also focused mostly on the advantages of knowledge discovery in open networked environments, although some of the disadvantages were raised as well. The workshop brought together a set of stakeholders in this area for intensive and structured discussions. The purpose was not to make a final declaration about the directions that should be taken, but to further the examination of trends in computational knowledge discovery in the open networked environments, based on the following questions and tasks: 1. Opportunities and Benefits: What are the opportunities over the next 5 to 10 years associated with the use of computer-mediated scientific knowledge discovery across disciplines in the open online environment? What are the potential benefits to science and society of such techniques? 2. Techniques and Methods for Development and Study of Computer-mediated Scientific Knowledge Discovery: What are the techniques and methods used in government, academia, and industry to study and understand these processes, the validity and reliability of their results, and their impact inside and outside science? 3. Barriers: What are the major scientific, technological, institutional, sociological, and policy barriers to computer-mediated scientific knowledge discovery in the open online environment within the scientific community? What needs to be known and studied about each of these barriers to help achieve the opportunities for interdisciplinary science and complex problem solving? 4. Range of Options: Based on the results obtained in response to items 1-3, define a range of options that can be used by the sponsors of the project, as well as other similar organizations, to obtain and promote a better understanding of the computer-mediated scientific knowledge discovery processes and mechanisms for openly available data and information online across the scientific domains. The objective of defining these options is to improve the activities of the sponsors (and other similar organizations) and the activities of researchers that they fund externally in this emerging research area. The Future of Scientific Knowledge Discovery in Open Networked Environments: Summary of a Workshop summarizes the responses to these questions and tasks at hand.
